Extending K1 Visa

Timeline

My fiancé and I would like to extend our visa until September of 2014. My NOA2 has been sent to Brazil to start Fernanda’s visa interview process. Does anyone know if this can be extended? Or will we have to start the K1 visa process all over?

NOA2 is good for 4 months, I believe, before you MUST have the interview etc, and then K1 must be used within 6 months, and then you don't have to marry for 90 days, so 13 months from NOA2 date is as far as you can stretch it, so no, I think you'll have to start over.

I think you will need to start all over again...the noa2 is valid for 6 month...during that time the NVC and the local embassy must interview her and make a decision wether to approve or deny your petition. If she shows up to the interview and make it, she still have 6 month to leave brazil. Once she arrive to the States she will only have 90 days to get marry with you.

If you guys are not ready to live together, you should call the USCIS toll free line and cancel your petition and start over by april or may 2014. In my 2 years being a Vj member I'd never read case where the visa can be delayed or reissued. I think you've a frame of time to work, otherwise your petition will be revoked.

I think the best thing for you is call off your plans and cancel your petition and file only when you are truly sure.

A visa can only be re-issued for very good reasons, such as an elderly relative suddenly gets sick and the beneficiary needs to look after them, or I have seen one case where the beneficiary wanted to wait until the end of the school years to bring her kids with her. Delaying 1.5 years is not an option that way.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
