Timeline

Hey guys, im a November filer and I got an RFE.

They are asking for the following

- Birth certificate of any children, adoption decree, school reports, medical records for step children - (We do not have any children yet)

- A will, trust or a power of attorney for health care or property or both. (Is it a good idea to get one of these right now?)

- Joint installments, loans or credit card statements - (We do not have this)

- Joint utility bills - (we only have one bill in both our names and I sent it)

- Affidavits from family and friends (Can get these but do they have to be notarized?)

- Lease showing joint occupancy - (We don't have a lease. We live in a house provided for by our employer and he pays all the utility bills. Can I get a letter from my boss explaining this and also an affidavit from him)

- Deeds and mortgage -(we don't have this too)

I submitted:-

Tax returns 2010, 2011 and transcripts

Bank statements

Car titles

Auto insurance cards and bills in both our names

Vehicle purchase agreement in both names

Payroll statements in both names

Copies of receipts showing our names

Copies of checks with both our names

Several photos

Guys, what else can I send. I need help here. Thanks.

Is your wife a named beneficiary on any employment documents? Like retirement?

You should get a life insurance - term life insurance is cheap. Name each other as beneficiary.

Make a will. You need 2 witnesses, best if you use a notary.

Get the letter from your boss about your living arrangement, I suspect this is what set off the red flags to USCIS.

We work as self employed and don't have any documents naming each other as beneficiary.

We don't have life insurance either. I can get a will and im working on that. I suspected that redflag too, im working on it and will have a letter from my boss explaining everything. Thanks.

I would add:

  • Bank statements from several months
  • Utility bills from several months. Depending on the utility company, both names may not appear on the bill. Only my husbands name appears on the utility bill and only mine shows up on the gas bill. But I submitted them all
  • Letters from two people that know you. Its nice if they are notorized
  • auto insurance summary pages from several periods
  • Phone bills

I submitted something from literary every month me and my husband were married. Some periods I covered with the gas bill, some utility bills, some car insurance policy statement

Don't worry, RFEs are pretty common. My goal was to mail a thick packet. You will be fine :)

I got an RFE and I am from Germany.

You think Canada would drive a RFE?

12/23/12 = Got the bio-metrics done (USCIS Status: Pending)

That's all I can get for now. Just wondering if its necessary to get a Power of Attorney right now.

What Power of Attorney has to do with this? unsure.png

Power of Attorney is akin to signing your life away to another person, so, maybe, it can be viewed as "trust" in marriage.

It's a useful thing, when it's needed, but to me, it's sort of pointless between a husband and wife. (I, for example, have power of attorney for both of my parents, so to me, that's different).

I was asked to provide that evidence in my RFE. Either a durable power of attorney for health or property or both, Will, or Trust.

Evidence of estate, health and financial planning is considered by USCIS as evidence showing a good faith marriage. Such documents include, wills, trusts or a durable power of attorney for health care or property or both.

So that if you become a vegetable your wife can pull a plug and collect your life insurance money :)

Yet, she can do that without the power of attorney anyway (based on the given state's laws).
