Dear All,

We are in situation:

1)Leave home country in January, 2013. with wife and 3yo son.

2) Apply for Asylum in April

3) May - we won dv lottery

4)We are on B2 visas, and I-94 expiring at 13 July.

5) our dv number 56XX

6)We sent at 2 May DSP-122 and DS-230 to Kentucky.

For now I investigate next:

1) We can ask USCIS to reschedule interview untill I-94 expired but from the moment our dv number became current.

2) We can ask Free Legal Service provider to help us.

Questions:

1) Do I have to write any letter to Kentucky and about what ?

2) Do we need to sent any letter to Asylum office ?

ANY OTHER RECOMMENDATION AND HELP WILL BE GRAITEFULLY RECEIVED !

His problem is - he needs to be in status where his cut off number is current in Visa Bulletin and chances for that are zero. Interviews will start in September 2013 and no once will do anything until then.

Also, if the asylum claim is considered frivolous and is denied - he will be deported with lifetime ban. Best chance to get GC out of DV in this case seems to be go home and interview there.

That you can try but you have to have a good reason for extension and depending on your cutoff number your extension may not be sufficient.

If denied you will be accumulating overstay which will make you ineligible to adjust the status - pretty dumb way to loose a GC which otherwise you will be almost certain to get it...

Reason is I wanna get GC without leaving US, and actually I can because I pending Asylum, I can extend for 6 month - its more then enough.

"If denied you will be accumulating overstay" - I think overstay will come whem my I-94 will be expired, correct me if i wrong.

"Certain to get" - dont you think in my home contry immigation officer will be confuced by my returning in contry where I was persecuted ?
