ok, said spouse filed for VAWA with a valid police reprt for domestic violence in may 2012. but spouse had earned over $100k in 2011 and not paid taxes on 90% of it. (cash independent contractor jobs). probably the same in 2012. this was reported to IRS in fresno cali, tip line, to home country embassy, local ICE in usa, and VAWA unit in Vermont. whats the odds any of them will pursue any investigation of spouses tax evasion/marriage fraud/VAWA application? how would it affect the VAWA AOS?

Alleged tax evasion is not in the purview of immigration authorities; only the IRS would be able to investigate it.

There is almost no chance the USCIS and IRS computers are not linked I bet. You would have to connect the dots so to does for USCIS and that will not be easy at all. With the conviction for DV almost anything you do will seen done out of spite and not be read. Or discounted. Sorry bud you are in a tough spot for stopping a green card. What amazes me the immigrant spouse has move power than the USC we should be allowed to be heard but instead we are pushed to the side ignored and our thoughts and feelings are marginalized out of the picture, and the USC spouse is left out in the cold with no rights. Sorry for your troubles.

Uscis won't give a damn in her Vawa case regarding tax evasion.

You stated that she has a 'valid police report" then i assume you are an abuser, because if you were scammed you would not refer as a "valid police report" but as a" fraudulent police report". If she has a valid police report then probably they will approve her case and Justice will prevail.

Just an FYI. When I filed for my wife to come here on an IR-1, NVC approved my I-864 and sent it off to the consulate no problem. When my wife went to the interview they gave her 221g because I had a tax lien. So they deducted the tax lien from my previous years income, and said I was under the poverty guidelines due to that. So something is linked somewhere. Odd thing was that NVC approved the I-864 before they sent it to the consulate.
