Hi!

My fiancé and I will be getting married in the United States using k1 visa. We will then file for an AOS and hopefully an advanced parole.

My fiancé will need to leave the country shortly after the AOS/NOA is received so that he can finish a large business project in his native country. If he doesn't return to his country by a specific date, he will effectively lose his job and will lose his transfer to the USA once he gets the EAD.

My question is does this situation fall under the extreme financial loss to company or individual and would be eligible for an expedited AP? If not, what does "extreme financial loss" mean in the AP processing?

Thanks!

Don't move and get married until after the business project is over. There is never a guarantee that expedited AP will be granted, and you will be at their mercy once in the US.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

That's not possible since the k1 will expire before project is over...

A K-1 is good for 6 months. You are saying this project will take 6 months? You can't really travel on AP for 6 months anyway...
