I-864 for co-sponsor on K1 visa

Well, I didn't want to go this route, but it looks like I will be needing a co-sponsor for the K1 visa. I know Manila doesn't like co-sponsors for K1, but I've seen that a few people have been approved with one. Looks like the cases approved were cases with the following: 1) co-sponsor was a close family member, 2) turned in form I-864, 3) both USC and fiance attended interview. My dad will be my co-sponsor. Unfortunately, I most likely will not be able to go to the Phils for the interview. My question to those that have been in this situation is how many of the I-864s do I need to submit? I plan on submitting 2 I-134s (one for me, one for dad). I just wasn't sure if I needed to submit an I-864 and my dad submit I-864A....or if it's just him that needs to submit the I-864. I read on another thread that one couple here on VJ submitted the I-864 & I-864A. Other people it seems only used 1 I-864 for the co-sponsor. Just didn't how how that would work because when it comes to AOS time, wouldn't I be submitting I-864 for me & I-864A for dad? Or am I just confusing myself? :/ Thanks in advance for any help you guys can give me! :)

You both should do the I-864 with supporting documents, still no guarantees with Manila, but its seems they have been better about approving them. I know of a few that have gone this round and, the USC did not attend the interview, they got approved.

As for AOS that is a whole new ballgame as that will be with USCIS. Not sure which form is used by the co-sponsor during AOS.

at the interview stage at the Embassy. I don't think which way matters ,since at that point the Affidavit of Support is not legally binding. having an I-864 at the interview would show you have a willing joint sponsor when it comes time to AOS . For AOS,you would submit an i-864 and your dad would submit an I-864A if you are living in the same household. if living in separate households, you would submit an I-864 and your dad would submit an I-864.

The I-864 is legally binding, that is why its not used at the K-1 interview because it is binding and for the K-1 to "perfect" the couple has to get married within 90 days of entering the USA and if they don't and the beneficiary returns to their home country the USC has zero obligation with the I-134C as it is not binding like you said. But this is why some are using the I-864 with the K-1 when having a co-sponsor it has teeth.

I called USCIS during the waiting stages and it was suggested by a customer service rep that I use the I-864+I-864A instead of the I-134, when we went to the interview we had I-134(s) myself and my father and the I-864 with I-864A(s). When we got to the filipino pre-screener we never even showed them the I-134, but they did inquire about it. I had written a letter indicating who I spoke with(Name and Badge#) and when I spoke with them, and stated it was there recommendation( the customer service rep from USCIS) that we used the I-864, they had a little discussion with the supervisor, about my lack of I-134 but they never pressed the matter and let us continue, without incident.

yes, the I-864 is legally binding for the sponsor of an intending immigrant. a K-1 Visa is non immigrant visa, at that point technically not an intending immigrant, which is why the I-864 is not used when applying for the visa. when the K-1 beneficiary applies for AOS, they then become an intending immigrant.
