hi guys, i had a question. Last week i got marijuana possesion charge

and im getting married in june overseas. When i file my spousr visa

or fiance visa i havnt really figured that out yet, will there a problem

for me? Should i be worried at all? Appreciate everyone.

If you are the US petitioner, it should not be a problem. People have successfully petitioned even from prison. The only crimes that bar you are crimes under the Adam Walsh act for which you cannot obtain a waiver.

If you are the foreign spouse or future spouse who needs the visa, you had better get an immigration lawyer experienced in your type of case without further delay.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

You cannot file a fiance visa if you get married. You would only be filing a spousal visa after your marriage in June.

No, that's exactly what I meant :) Didn't want him to rush rush to file this month as a fiance if he didn't think about it. :)

If you plan to file after you are married, you will first need to file the I130 petition along with the filing fee. Search the forums to find out what you need to submit with the petition. There are forms you will need your wife to sign.

If you want to file prior to getting married, I belive you will submit/file for a K1 Visa but you have to have met your fiance within a specified time period prior to filing.

The Us embassy frequently checks the marriage registries , expecially in high fraud countries. So if you file for a K1 when you are really married there is a good chance that your K1 will be denied and you wait all over again. If you manage to slip by and at any time in the future they find out you were married when you got the K1 all immigration benefits you have recieved ( Green card or more ) can be revoked for fraud.

This will not be over quickly. You will not enjoy this.

First off pardon me for saying this but are you insane!!? protest6wz.gif You are going to blantantly commit immigration fraud that not only can get a life-time ban but maybe jail.

Forget anything being faster dear. After summer you be lucky to get anyone or anything here under a year. Right now I-130's getting approved inder 60 days(ay USCIS thats lightening quick).

If you marry you file I-130 there's no cheating or pretending. This is the US government okay.

As stated before you are the citizen your drug charge is of no issue unless you are a convicted drug dealer than thats different so stop stressin the little things and please do not lie to immigration ever.
