Hello!

I am the petitioner on behalf of my wife and her two daughters. I am in the process of completing the AOS form and can not get a joint sponsor.

I can only claim the most recent year as income with federally filed tax returns because I have not been living in the USA for the past 6 years but have worked there in 2012. So, I can correctly fill out the form and supply 2012 tax returns for the most recent year but can not claim income from federal tax returns for the previous two years.

Has anyone ever been in this situation and if so what was your solution?

Does anyone have any advice as to how solve this?

So you have held the same job through 2012 as you are holing now, and will hold for the foreseeable future, and it is above the poverty guidelines? You should be fine then; simply add a short cover letter with the I-864 explaining why you were not required to file taxes/ had no income for 2011 and 2010.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Getting a joint-sponsor is the easiest way to get through this.

You can check the poverty income guidelines here: http://www.***removed***/affidavit-of-support/i-864p-poverty-guidelines.html

Even if you do meet the required income, they might ask for your previous ITR in 2010 and 2011. And ultimately you'll still going to get a joint-sponsor.

If their interview happens on 2014, make sure to send your 2013 ITR cause they will need it there.

Yes I have had the same job for years and will continue the same job and the income meets the 125% above the poverty line requirement.

I had heard about the idea of including a letter of explanation and I'm glad to get more confirmation here that this can be enough. I'll give that a shot!

Unfortunately a joint sponsor is not an option for me. I will have to include a letter of explanation and hope for the best!
