sorry, tried to find this question in the forum but couldn't figure out how.

my bf wants to come next month to live with me, finally! and if everything goes right i will get my citizenship in 2-3 months, with his tourist visa he can only stay for 3 months so we want to get married in the town hall of the city that i live at and then fly to hawaii for our own enjoyment and fill the paperwork right by the end of those 3 months when supposedly by then i will be a us citizen.

would it be a problem if he marries me while i'm a lpr instead of a us citizen? or what really counts is your status when you send the paperwork please?

There's nothing wrong with getting married while still a LPR, you can file once you're a citizen, but why don't you wait a couple months so you know you'll have your status and can file the papers right after your marriage?

He would need an immigrant visa, not a tourist visa.

It's visa fraud for him to come on a visa waiver/ tourist visa with the intent of staying. You two getting married on his visit is fine, but NOT him staying/ immigrating, don't risk it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It's not completely clear from your post, what you're intending to do.

If you're planning to have your boyfriend visit, and marry you while he's there, and start the paperwork -- then he HAS TO LEAVE again when his tourist visa / 3 month VWP is over. He must return home, he cannot simply stay with you after getting married -- that's visa fraud and can lead to a lifetime ban on ever entering the USA again. Do NOT do that.

If he leaves after you're married, that's ok! Then you file the CR-1 after you're a citizen and you wait and wait and wait until he finally gets the approval to come and live with you permanently. That's the only option.

I don't think it matters whether he marries you before or after you transition from LPR to citizen, but I haven't followed those discussions so others should answer that!

2024 February 13: naturalization interview (five-year rule) passed, same day oath - now a US Citizen and done with USCIS!

you can get married while you are an LPR as others have send. You can also send in the I-130 after that and then request an upgrade after you become a citizen.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)
