Requiremnts for a missing parent not married to the other parent are: BC with both names,

financial support sent to the, other with custody, birthdays and xmas,cards, phone records,

pictures, attendance to school or sporting events of child,(if in a visa required country show

attempts to obtain visitor visa)or graduation, & at times DNA is requested even though the

both names where on BC at birth.....USCIS wanted to weed out dead-beats parents that could

not find these off-springs until they become adults & is able to petition them , so BC & DNA

alone is not th only answers, they are saying show consistent parent support & attachment when

these petitioners were youug.

I understand that they want to weed out certain applications. But I was trying to have contact with my daughter but the mother was not complying with the court orders because I was in the UK. I sent money, and tried to contact my daughter but she kept moving and would not let me or my family have any contact and no address.

Yes, I did. We came to mediated settlement. She agreed to send school reports, up to date pictures phone calls and for me to be allowed to visit my daughter. This is what our lawyers worked out and which we both signed. Once she was out of the UK she didn't comply with the order.

What do you take the mother to (US) court for ?

From wht I understand the agreement was made in UK and once mother left UK she was not complying with court order.

Its just me but someone with experience in similar case can chime in, just the photos from time she as 4 and other church docs would not be strong evidence.

You need more documents about the recent contacts to prove your relation.

Yes that's correct it was in the UK. The main situation here is that INS did not refuse me on the grounds of lack of evidence. The heading on my post is misleading - that's my fault. My case got denied because my lawyer did not inform me of the deadline for evidence to be produced so they considered the application abandonded. He didn't even inform me, I had to inform him and he has not returned any of my calls since.

If I had known what the deadline was I would have given them what I had. My daughter has spent time with me since I was reunited with her and I took her to see her grandmother and cousins.

You won't be successful in a motion to re-open. You would need to prove that USCIS made an administrative error or an error in law to do this, and you cannot because their decision to deny you was based on your lack of response to an RFE which is an automatic denial.

Yes, that's the conclusion I also have come to. I finally managed to speak to my lawyer today and he told me I could even when I told him I didn't think it was possible due to his negliance. Yet he still persists in saying it can be done - I don't believe it can be, so I think it's best I just cut my losses with him and file again.
