Ohhhh, okay. Well thank you very much Mr. Karee. I am so ignorant to the blogosphere. This is my first experience using this forum, or any forum, and it has been a terrrific experience. I cannot believe the knowledge out there and the willingness to share it.

1. You're lying to immigration, basically.

2. You don't change the filing, you write to USCIS and withdraw your support of the joint filing. She will get notification of this and be told she needs to change her filing method

3. Doesn't sound like your relationship is fake, but it does sound like she has no issue lying so... who knows

4. ICE information is at the bottom of the page.

When withdrawing your support you could send the evidence of the fake DV charges but really I think you need to show her the instructions for the I-751 (or her attorney would be safer) and show her that false abuse charges are NOT needed. In fact, I would explain to her that lying to immigration is worse. I would also tell her that you'll help her with the evidence of good faith marriage that she needs.

The divorce taking a while won't affect her either. She will need to submit the decree to get approved but this happens to plenty of people, it's not a big deal.

Mostly you need to 100% stay away from her. It seems she has no problem lying about you hurting her even when you're not there... I suggest you take out an RO against her as well.

I met wtih the officer at the USCIS today. Since the filing was maied in March, the do not even have the application on their books as yet. She recommended I put everything in a letter and send it to that office.

Any suggestions or advice on this step at all?

you have a receipt notice, which contains an address.

Copy the receipt notice and include it with the letter, sent off to that address in the receipt notice.

It's interesting the fella at the infopass couldn't see the receipt in the system.

the Officer also suggested I send the letter to the local office and the California Service Center. I do not have the copy of the receipt, but I do have the WAC number. My wife took all of the stuff wtih her. I also thought it was odd that the official could not see the application on line. Oh well, I will send the letters and hope those get through. I may also bring one in physically to the local office. She said to make the ltter Inter-File in red. What might that mean?

did you go to yer local office or some other office? i am confused.

My apologies. I am still very new at this stuff. I went to my local office. It is my first expereince wtih them. I have to say, the person that i was seeing did not seem like the sharpest tool in the shed. I asked the same question many times and would get slightly different answers each time. The best I came up with ffom her info is to send a letter stating I have filed for divorce and I wish to cancel the joint Application for RoC's. She said to send it to the local office and to the California Service Center. I was also considering walking a copy in to the local office.

Do you recommend anything else?

1st step is to send the documents of cancellation. Avoid the Pain .

2nd Protect yourself w. Proof

a) You had a few weeks of reconciliation in wish you gain crucial information . I hope you collected as much evidence and possible of your statements on her .

b) Why you will ask . for 2 very important points

1) She lies to get what she wants and put you in Jail( she did that one’s already)

2) What happens if she lies about the true nature of your relationship ? ( He ask me for money to marry etc.) That is a new headache that you don’t need .

We all know she is getting her 10 years however is going to be harder and I warranty that she is adding abuse on it.

Trust me on this . I’m a Person that was marry to a Lair and unfaithful person before I re -marry . and thanks to me keeping proof on everything I keep my baby girl , My Job and my House . my ex still trying to get herself on her feet after almost 8 years . That was thank to my Lawyer that give me the same advice I’m giving you . keeping record of everything .

We leave in a society that Favors the female population on this type of situation and it can take us long hours , Money, headaches and even jail time . All that to get the truth out .

I appreciate your words and advice. An update:

I have mailed my letters of cancellation of joint application to both the CA Service Center and the local USCIS field office. Both receipts have been returned to me. She is now out of my house and out of the state. She refuses to investigate how to file her own RoC, I-751. Our divorce is proceeding with a Summary Dissolution. Most importantly though, as I have mentioned before, the DV charges have been dropped by the DA.

So far, so good.

GREAT NEWS!!!!!!!!!!!!!!!!!!!!!!!!!!!!! Change the divorce to fraud and get a annulment based on fraud if you can. It is great news she is out of the state and our of your life:)

Don't know if you thought of this already or not. Change the locks on your house if you have not already. You do not want to come home some day and find her in the house and try and do what she has already tried to do with the false claims.

11-08-2011 Date on text messages but did not receive until 11-22-2011

11-23-2011 Check cashed.

11-25-2011 Hard copies of NOA1s

12-06-2012 Pui's Brother unexpectly passes away and we make an info pass appointment and receive an emergancy AP so she can return home. Pui leaves for Thailand for 2 weeks.

12-06-2012 Get a text message and email that she received an RFE

12-12-2012 RFE for original birth certificate. I swear we sent it along with a certificate translation of it.

12-20-2012 Pui returns from Thailand.

12-21-2012 We send the RFE back for with original birth certificate along with a new certificate of translation(I had to wait for her to return for her to sign)

12-26-2012 text and email they have received the RFE.

12-29-2012 Appointment for biometrics is 01-23-2012

01-13-2012 AP is approved.

01-23-2012 Biometrics appointment. Later during the evening the text and email saying the EAD is approved.

01-31-2012 EAD/AP combo card arrives.

05-22-2012 Email and text card is in production!
