Hi Guys!! Well its been awhile since I have posted anything on this forum...Guess I should start by saying that when I first joined I was in a relationship with another guy from Mexico and we had plans to marry therefore I filed a K-1 visa for him. However, with him being deported to Mexico at the start of this whole process our relationship was over stressed and I later found out that he had a family in Mexico and yes not only kids but a wife as well. I confronted him about it all and he admitted that he was only using me to get a green card. During this time I got a letter asking if I wanted to appeal the decision and gave me a time frame to do in, I however didn't do anything and ignored the letter and called USCIS.

Ok fast forward......about almost 2 years ago I met my now husband through his brother and sister in law (yes it was a internet relationship). However this past March I vacationed in Colombia with him and we got married. Now my question is where do we star? I know that I can't file a K-1 because we are married, however which way would be quicker for us to finally be togather. Also, as long as I am honest with USCIS and tell them about the other form I have previously filed would that affect the process with my husband?

Where are you and where is your husband?

If your husband is currently in the US, how did he enter?

As you are already married you need to file the I-130 petition for the CR-1 (conditional residency). Less costly than the K-1 and a tad more time consuming (around a month longer).. Assuming you stay ahead of the game and have paperwork prepped before hand for the NVC stage you can figure roughly eight months from the time you send in the original paperwork to the final interview in Bogota.

If you did the paperwork to get married in Colombia then the process for the CR-1 should easily be doable. The guides here and the once-in-a-while panic posts eveyone makes while goign through the process should be all that you need.

Sorry I didn't mention that. I am actually back in the States and he's in Colombia. And no he has never set foot in the USA before.

Thank you so much for your help!! As of currently I am waiting on our marriage license to get here since I had to return back to the States before hand. I believe that once we have it translated and my name changed we will be really to go. I have seen where there are some long waiting times and that is what is really scarring us that this time. Guess my next question will there be a time during the process when I would have to be present at the interview?

no prob - the wait is no fun but once you get through the first USCIS hoop it goes pretty fast. As far as the interview - technically you don't have to go to the interview, only your husband needs to attend though it would probably help if you are with him. The interview takes place in Bogota at the very end of the journey - assuming the interview goes well and you can wait around a week or so for the visa he can return with you and you will be done being apart.
