Timeline

We filed our I-129F in February during which time I was staying with my fiance in Texas, USA. We received our NOA1 dated 13th February 2013 and I returned to the UK on March 18th, having been in the USA for 89 days. Having returned my original intention was to stay until I received my K1 visa.

However having registered on this site it would appear the 5 month waiting time for an NOA2 is more likely to be 7 months or even more. I am therefore looking to return to the USA mid June and stay until around 27th-28th August. I understand that it is important to have evidence of my ties to the UK and to be prepared with evidence to support my genuine return to the UK in August.

As well as the obvious reason of not wishing to jeopardise our Visa application, I have a home for sale, my Mum and Dads 50th Wedding Anniversary, and my Son's 20th Birthday. I will take with me copies of evidence to support all this along with copies of the I-129F submission.

My question is this. If the NOA2 arrives with my fiance while I am in the U.S and then the paperwork is subsequently sent to the UK does it matter that I am in the USA. I appreciate I will have to come home to organise medical, paperwork etc and send the package back. On the plus side I will be able to return to the UK with up to date letters from my fiance regarding employment, her intentions to still marry and her current bank statements.

Any advice will be greatly appreciated,

There is no law against visiting the US. It doesn't matter where in the world you happen to be when the petition is approved. This thread has good information for K1s going through London. Each country does it differently, so don't get off-course with what happens at other consulates.
