I am a Nov 2012 filer. Yesterday I got an RFE letter from USCIS stating that my marriage is not in good faith. Here are the list of documents that I submitted:



1. Joint tax return of 2010 & 2011 (I will submit 2012 tax return in my RFE)


2. Our apartment lease contract.


3. A letter from our join bank account.


4. Copy of my wife's personal signature card.


5. Letter from auto insurance company.


6. Letter from Social security administration.


7. Auto insurance policy for past 2-3 yrs.


8. Explanation of dental benefits from Metlife.


9. Certificate of group health plan coverage, explanation of payments, and explanation of benefits from Blue Cross Blue Shield.


10. Benefit enrollment from my employer.


11. Joint phone bill.


12.Affidavits from 6 friends.


13. Copies from B'Days cards.


14. Lots of pictures.



I can submit these documents more as evidence:



-Copy of Tax Return 2012


-More bank statements.


-More affidavits from friends.


-I can buy life insurance policy stating she is my beneficiary.


-Co-Owner of my motorcycle


-I have a car but its on loan, so I dont have any title with me.


-She has the title of her car, we can put my name as a co-owner of her car.



Anything else should I chip in? We dont have kids.

11/22/12 = Filed I-751 to remove conditions

11/30/12 = Got NOA1 (I-797C)

12/23/12 = Got the bio-metrics done (USCIS Status: Pending)

To add on this: USCIS says that we dont have shared assets/liabilities spanning the period of the marriage that we continue to share a life together.

11/22/12 = Filed I-751 to remove conditions

11/30/12 = Got NOA1 (I-797C)

12/23/12 = Got the bio-metrics done (USCIS Status: Pending)

Hi Klm,

How about...

Joint credit card statements

Driver's Licenses showing both your addresses

Bank statements from the date you got your cr1 approved ( I printed all the statements from the date I got my cr1 up to Nov. 8 filed in Dec.)

Copy of your auto insurance policy with both your names

Insurance or retirement beneficiary

Insurance ID cards

The affidavits from friends are ok but it's not that solid, I didn't submit affidavits during my ROC just all bank statements, credit card statements copies of all health insurance policies, our Roth IRA beneficiaries ( we are each others beneficiary) car insurance policy, joint federal and state tax filings, driver's licenses, documents relating to our home purchase. I did not submit photos. Organize your paper work according to categories so they can see what they're looking for immediately.

To add on this: USCIS says that we dont have shared assets/liabilities spanning the period of the marriage that we continue to share a life together.

They want to see proof of co-mingling from the entire 2 years of your marriage. Send in bank statements from joint accounts covering the last 2 years. Joint bills, credit cards, insurance, phone plans, etc. spanning the entire time of your marriage. Sending in only one of each type of evidence will not do it for them. It is important to show them you have lived as a married couple for the length of your marriage. Check out other RFE threads here in the ROC forum. There are lots of suggestions for what types of evidence you can send.

I posted an answer in the DEC filers thread, but here (most of it) again:

Definitely 2012 IRS Transcript along with many bank statements (covering all of the month of marriage, at this point) would be the best evidence. Send more joint bills.

Another thing: do you have any credit cards together? If you do, get a letter from the CC company saying the account is joint (or you are an authorized user).

Pull credit reports for both of you (from www.annualcreditreport.com - it's free once a year and does not affect your credit). It will show addresses and any co-mingled finances.

Copies of any government issued ID showing the same residence helps too (in conjuction with the lease, for example)

Other than that, nothing else comes to mind.

This also might be helpful..

When you go to the Dr's office or Dentist, you filled a form with your contact info and incase of emergency. You can request copies from the Dr's office and/or Dentist and send it as well.

Just got our first RFE ever in this entire process...USCIS is a bunch of morons if you ask me, I will never think a milimeter higher of them. They delay us, a normal loving couple, but others who are clearly trying to work the system, get approved faster than anyone else. I don't believe anyone competent works there. I've sent a huge folder of documents they asked for, including financial stuff and more pictures and proof, pretty much same thing you sent above...yet we still receive RFE asking for the exact same things we sent in, including BIRTH CERTIFICATE which they should already have. I wouldn't be surprised if those incompetent fools lost our documents.

N-400:

02/21/2015: N-400 sent via USPS Priority Mail to Phoenix, AZ Lockbox

02/23/2015: N-400 received by USCIS

02/27/2015: Check cashed

03/03/2015: I-797C, Notice of Action received

03/26/2015: Fingerprints done!

08/24/2015: Notice of Action received, Interview letter!

09/28/2015: Interview day, PASSED! Oath Ceremony same day :)
