I wouldn't be surprised is there are any workers from the USCIS here.

You like other people here are right. I do need a lawyer, no doubt.

Then again, there is too many hater. I thought this was a forum where you can ask for help and advice. I guess you also get the bad part too.

I think you misreading most of the posts. They're not haters - why do you think they would hate you ? You're not someone that tried to misuse the immigration system. They're giving you honest assessment of your situation - as it really is pretty simple - just you don't like the answers.

Just when you hire the lawyer - make sure it's a good one. There's plenty of those that will take you money and sell you bs about how they're going to fix this for you. Good luck...

Look, there are too many people here with great negativity. Should I panic? no!

There is always a solution, and my solution is to go to a lawyer and see what they can do for me.

There are too many people here thinking they are experts in this area. All i wanted was for advice, not to be all haters and tell me that I'm an illegal, and that i should leave the country and ####### like that.

Forst of all, I have kids here and I will never leave them alone, I'm their father.

###### happens, and it happened to me. Is it a big big mess, hell yeah, but i wont lay down and die because of it. Instead, I need to find a solution. With haters like most people in this forum, anybody can die and give up in life.

Anything I said was the truth. You don't seem to be taking this as seriously as it is so you needed to hear the "worst case" stuff so you realise - this IS serious. This isn't just a "lets see what happens".

Good news is you don't appear to be in removal proceedings. That's good but still not great. Now you would need to file I-751. They don't just accept late filings. You need a CONVINCING reason for why you're filing this late. While all the happy stories about "I know someone who filed this late..." are all well and good, the people I know that filed late (and helped with their filings) had extremely good reasons and were only a couple of months, not several years.

Also, it doesn't mean you WON'T see your kids. It means your kids will need to visit you in your home country.

And, though e-verify worked, it shouldn't. When you complete the I-9 your employer will see that your card is expired. They should not let you work. You would not be able to renew your drivers license either. Basically you are illegal and in limbo until you get something from USCIS that states your status is extended (though the letter says "for one year" and you are quite obviously over that time frame).

You need a great attorney. I suggest you speak with several. The great ones will tell you the truth, that your chances aren't good, but will tell you for a fee they can try. The good ones will tell you your chances aren't good and suggest a top-notch attorney to help you. The bad ones will tell you it's not a problem.

Again, this is EXTREMELY serious. Attempting to fix this needs to be your number 1 priority. Your second priority is looking into returning to your home country so you know what is involved if/when you need to do that. Being prepared will put less stress on your and your kids.

It's a shame neither you nor your wife at the time thought your status was important enough. You'd be a USC by now.

wow reading the OP, really wow, careless and a don't care attitude, 'I just forgot, hope they don't make a big deal out of this' After reading this I didn't know I should be angry or laugh at it, all I can say is 'wow'. You will be spending couple thousands to lawyers.

Yup so you want advice not criticism, I get that but it's hard for people to ignore the comments you made, `hope they don't make a big deal out of this`. wow lol I still can't get pass this. You also say 'You've been a good citizen', first of you are not a citizen, just a conditional resident, you've been giving conditional residence and there were rules and regulations to comply and you failed to do so, in fact 'you've been a very bad Conditional Resident'.

I am going to repeat what others have already said, you've been out of status; an illegal immigrant from the day your GC is expired, since you don't have a case pending, also any company hires undocumented illegal immigrants is also breaking the law. they could face serious fines.

and yes, you could've been a united states citizen by now, what a shame.

I have heard of some of the states not asking for any immigration documentation at any point.

So Nevada must be like that.

Doesn't make your life any easier.

Also, to me it seems like we are missing some sort of information here....

1. Your 1st driver's license would've had a "temp immigration" status (or early expiration date on it), so how it got renewed then, puzzles me. Unless, of course, it was in one of the states where they don't care (and that's a whole other story)

2. Your employer, by hiring you, pretty much agreed to pay a huge fine... You mentioned "they did not care that the GC was expired".

All of this seems to add to your nonchalant attitude.

So how did you prove that you are a legal resident or have a special visa to renew just a month ago if you've been without status/greencard for years?

OK, so here are my issues with this:

1. Are you sure you don't have a 10 year GC and you are just jerking us around?

2. I will not, I repeat, will not believe that both DMV and your employer negated the expired GC and issued DL and work authorization (i.e. hired you)

3. When you filled out your I-9 were you asked for your GC? Have you presented your expired GC to the employer's HR office? Were there any questions?

4. When you went in to renew your DL for the first time since it was issued were you asked for any proof of immigration status? Have you provided it? Was your licence expiration date the same as expiration date of your GC (or close. In NJ, for example, they put expiration 3 months from the GC expiration date)

Something is amiss here.

Wait a second here. You said you got your GC but you didn't explained if it was a Conditional GC or not. How long were you married before you got your GC?. If you were married for more than 2 years you maight have gotten a Permanent GC, in which case the only thing you'd have to do is renew the card.

If you got your Conditional GC (valid for 2 years), you would then had to file form I-751 to remove the conditions and bring your conditional status to Permanent status.

Please elaborate on this.

Wait a second here. You said you got your GC but you didn't explained if it was a Conditional GC or not. How long were you married before you got your GC?. 1. What is the expiration date on your GC?

2. What does it say under the "category" on your GC?

3. Please, amuse us, answer my questions about the employer and the DMV...

It will say CR9 if you got it thru marraige (CR stands for Conditional residence)
