I assume each time you moved you reported your new address to USCIS ? If not they may have years ago deported you on paper and notified the address of record.

If they have ( and the process is to do so ) then you have a lot of headache ahead of you. Illegals live in the US for decades under the radar. But you will not be able to get a new card based on your conditional at this point. You would have to have a new petition. You divorced your original spouse are you still single ?

This will not be over quickly. You will not enjoy this.

Alex you can be eligible with the ss administration because they don't share information with uscis at that level, but if you didn't correct your status like you point out your definitely in a illegal stance with uscis you have to correct this fast, because you could get deported. Its going to be a problem and you will probably have to go to court but you could win don't forget o get a lawyer a case like your will one.

If I need a lawyer or not.

I don't know how serious this situation is, but I have been a good citizen. I was married for almost 8 years and have two children.

The only problem is that I forgot to renew the card.

I hope they don't make a huge deal out of this.

It very serious, they provably are looking for you to deport you. Don't go into their offices they could try to deport you. Get a lawyer first an d let him Handel them but your situation is serious.

I'm not going to the office, I will make a phone call.

If it is this serious my SS would have been canceled. My credit cards and probably would have told my current employer to not hire me. I got hired by one of the biggest Hotel/casino here in Las Vegas, and the card was already expired.

So I don't know, I'm new to all this and I hope this is not a huge deal. We will see on Monday when I call them.

I will be very honest with u, I find it very hard to believe that u forgot about ur status, I hope these people do not think the way am thinking, it's like forgetting to eat in years and that's how weird it is. Please see an experience lawyer before anything. If it was the ten yrs green card u had, that would have been better.

Its that serious but the uscis doesn't share information in that way with other entities, and ones a SS is created it stays for ever in their data base. Even more,SS can't be cancel, I think , but not totally sure about this, because even after someones dies your social security number is still use by banks house mortgage lenders. I have been dealing with the USCIS for a long time now it's draconian entity.

Alex I am going to be hanging around visa journey for a few days. If I see a post from you inside that timeline I will answer you . if not i might not because I almost never come to visa journey anymore. I am only here now because my 10 year permanent resident card got stolen but after I finish fixing this I will leave again. I am just telling you this in advance so you know if you post me something too father in the future.

I would contact an attorney. You may be eligible to file for ROC waiver due to divorce.

You have children with the ex-spouse, I am sure there are other things you can provide that prove you entered into the marriage with good faith. I do not think it is all lost. Its not like you committed a crime that is of moral turpitude (eg rape, murder, theft etc). The most important thing is you entered the marriage in good faith.

It will take a little bit of time but I really do not think it is all lost. Take a deep breath. Worse mistakes have been made. I know someone who never even filed for adjustment of status because they thought that just the marriage was good enough!

This is so sad. Had you paid attention, you would have been a citizen by now. Please call a lawyer asap. Hopefully there is something that can be done.

Speaking of being a citizen...make sure you don't tell USCIS what you said here, that you've been a good citizen. The last thing you want is to be acused of false claim of citizenship.

Exactly 3 months from the day we got married till the day I had both SSN and GREENCARD in hand !

Day 1 01/22/2013 AOS package sent

Day 8 01/28/2013 NOA 1 received

Day 15 02/04/2013Biometrics appt letter for 2/25/2013

Day 16 02/05/2013 Succesful walk in biometrics 20 days early

Day 25 02/14/2013 USCIS status changed to Testing and Interview ready for interview scheduling

Day 31 02/20/2013 Email notification that my interview is scheduled for March 21st

Day 57 03/19/2013 EAD/AP card ordered

Day 59 03/21/2013 Interview at 10.30 am Seattle Approved

Day 67 03/29/ 2013 Greencard Arrived . Applied for SSN

Day 68 03/30/2013 EAD arrived

Day 74 04/03/2013 SSN card arrived

Eligible for ROC December 21st 2014

You are really screwed and need to start taking this much more seriously than you are at present.

You are no longer a permanent resident (and haven't been in five years) and are immediately deportable. You are not authorised to work in the US, you are not authorised to be in the US.

Talk to a lawyer, ideally more than one, ASAP, as in this week.

Under normal circumstances your wife could re-petition you and you would start all over again (USCIS are not going to accept a five-year-old application for RoC), but since you are divorced that is off the table. In short, you may need to look into making arrangements to leave the US, as I can see no route to which you can obtain permanent residency once more.

Talk to lawyers, do it soon, but don't get your hopes up. You have big, big problems.
