GC HOLDER FATHER CANCELS CHILD'S PETITION

Hi there i need some legal info.My 19 year old child is in the us on a b1/b2 visa her dad who is a green card holder decides to petition for her..now due to personal dissagreements he sends her to stay by me and has cancel the petition,i don't know for sure if he did..as i dont have her uscis info.im in new jersey and presently going through immigration process with my us citizen husband,what legal can steps can i take to help my one and only child ..help Please!..thanks in advance crying.gif

How are you going through the process? Ie did you come to the US on a K1, or are you a greencard holder, or...?

When did your child enter the USA/ how long does she have left on her B2?

How old was the child when you and your US citizen husband married?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Well not sure her dad will do that, ever if he did. Your USC husband can also petition for her.

I married my USC husband after my child turned 18...i came here on a b1/b2 visa and im presently in immigration process just got biometrics appointment..my child has a month left before her i-94 expires..

Your best option then is for the child to leave the US before his tourist visa stay expires and he accrues overstay.

As soon as you are a greencard holder, you can petition for him.

Send your child back to your home country as soon as possible. He might earn a 3-yr to 10-yr BAN for overstaying his b2 visa.

When you receive your green card, you can i-130 for him. He will be under the F2A category with a waiting time of 2 and a half years. He has to remain unmarried during the entire F2A process.

If it's not filed immediately, he might age out and turn 21 before a visa becomes available for him, so there's a chance he will be moved to another category which is the F2B category. Waiting time is 8 years. He has to remain unmarried during the entire F2B process.
