I think the minimum would be the most recent 1040 and W2. Some send the last 3 years worth. I sent the most recent 1040/W2 and then 3 years prior tax transcripts.

We haven't had our interview yet, so?

it states on the affidavit of support the last 3 years tax returns. that is enough to prove you can support the beneficiary.

as long as you have that, you will not need to send in any W2's because the tax returns show the amounts.

I know I have to provide 3 years of tax returns. Do I have to show 3 years of W2's, or just last years?

Let's see what the U.S. Embassy Manila says about the matter in their interview preparation instructions for K-1ers:

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

My advice: Submit your I-134, 2012 federal income tax return, 2012 W-2's, a few current paycheck stubs, and an employer's letter.

^^^ For K-1ers, Manila wants only the current income tax return. Also, Manila almost always asks for a W-2 to accompany an income tax return.

No need for 1040s and/or W-2s if submitting ITRs

^^^ A 1040 is an ITR (income tax return). You probably meant tax transcripts. If so, I still would advise a Manila K-1er to have the W-2 on hand just in case.

You may want to go ahead and order tax transcripts from the IRS for the I-864 form you will have to submit at the AOS phase. For the I-864 a COMPLETE tax return is required which is the form, W-2s and all supporting documents. Whereas a tax transcript is considered a complete tax return for the USCIS. It takes about 5-10 days to receive and they are free. I used them for the I-134 form too.

Good luck,

Dave
