Hello, I had a question currently I'm in the process of getting a divorced I understand I have to wait in order for me to petition for either visa K1 K3 or ACR-1 can any of you please help me I am a bit confused here. and last but not least I read that under ACR-1 Visa I can get Counseling direct fillling ?? Thanks

A K1 is a fiance visa, you both need to be free to marry (ie completely divorced) before start it. The K3 is nearly obsolete, forget about it. The CR-1 is a spousal visa so you need to not only be divorced but also re-married before petitioning/ getting petitioned for it.

The US citizen petitioner needs to live in a foreign country for 6 months before filing directly with the embassy. Additionally, the local US embassy must have a USCIS office, which Venezuela does not, so that option is off the table for you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi well there are many types of visas, base on marriage or engagement between an USC and a non USC.

first of all

K1: Is a kind of visa designed for a fiance(e) of a US citizen. Usually takes between 6 and 8 month. You cannot be married by the time you apply. Once the non US fiance arrive to the States, you MUST get married within 90 days.

k3: Is not longer exist.

CR1: is a visa for a foreign spouse of an US CITIZEN. Must be married by the time you apply. Usually takes between 8 to 12 month. Once your spouse arrive to the States usually the 2years green card arrive by mail 2 weeks later.

IR1: visa for a foreign spouse of a US citizen with at least 2 years of marriage. Takes 8 to 12 month. When the foreign spouse arrive, the 10 years green card is automatically granted.

In your case, you need to be free to marriage first. You cannot apply for any of this visas on behalf of a foreign spouse/fiance if you still have a divorce process still pending.

Once you are free to marriage you can apply for the k1 visa abring your fiance here to the States or get marry with her and then apply for the CR1 visa.

in this 2 cases she will need to wait in her homecountry for the approval and the interview. Once the visa is issued she is free to move.
