12 Month Work Visa - Drug and Alcohol Convictions

Hey everyone, I have a question regarding a 12 month work and travel visa I was hoping some one could help me with.

I studied in the US on an exchange visa a couple of years ago and during the time I was there I got an MIP (Minor in Possession of Alcohol), however I also successfully completed a diversion for the charge, which is defined below:

"The diversion agreement requires you to plead guilty, pay court costs, pay for and complete an alcohol education class and receive no other alcohol related offense for the four month diversion period. If you do all of those things, your guilty plea will be withdrawn and the charge will be dismissed."

A condition of the USA 12 month work and travel visa is that the applicant must have no prior drug or alcohol convictions, my question is do you think the MIP I received could affect my application ? Or is it safe to assume the charge is gone and I should just apply as if I never got it ?

Charges never go away for US Immigration purposes.

For immigration, the charges are never gone, they will be able to access them. You may apply but expect the charge to resurface

October 16, 2015 - US Citizen
