Hello Everyone!

I have been using VJ for quite some time now and have been following "quietly". I figured I better get on here and start posting! LOL This site has been wonderful and I expect it to help me keep my sanity through this whole process. I married my husband in the Domincan Republic 12/13/12. I just took my 8 year old son with me and we had a "courthouse ceremony" with us and a couple of his friends. We plan to have a ceremony in the United States when he returns.

I look forward to getting to know some of you throughout this journey!

One question I can think of right off the bat is the email I received that they received my I-130 paperwork says it went to the National Benefit Center.... is this how I can check on an average wait time for certain centers before I should expect the NOA2 acceptance? I thought it would go to a location, such as Vermont or Texas?

Vermont and California were (and probably still) painfully slow in processing requests. My NOA2 in Vermont took 8 months...so they are transferring some apps to other service centers, the NBC (Missouri) being one of them. I think NBC receipt numbers start with MSCxxxxxxx.

I don't follow MSC so don't know if it's a good or bad thing in terms of timing...check the threads. Igor's list is a very small sample set, and the gov't estimates are old, slow, and only display "goals".

They been sending I-130 petitions to NBC and usually from there to your local USCIS for processing. So it will be a hit and miss to get actual processing times because of that.

Hopefully your local office is not hosed up and you get the under 60 days adjudication.

Oh and welcome and congratulations on everything.

Welcome and congrats! The NBC is just another service centering, "helping" to process I-130'S they have been process applications farely quickly, So your pretty lucky to have had your get sent there, as suppose to the other centers that have been take over 6 months for processing.

Hi everybody !

I need help and i didn't knew where else to ask ..So here is the thing .

Me and my husband applied for a CR1 visa since we are less then 2 years in a marriage .

we have sent I 130 in April 2013 .. But the thing is that as i see it , It is better to apply for a IR 1 visa cause then you get permanent residence.. and with CR 1 visa you need to wait 2 years more after your entering in the States..

So my question is , if we have sent the I 130 in April this year for how long can we delay it ? cause it is better to pass 2 years of the marriage and then get IR 1 visa..

Please if somebody knows something please do write ,it is very important for us .

It all depends on how long you want to wait for your husband to come live in the United States. With the CR1 your husband will be allowed to live and work here. Later on he will receive his permanent resident card once the two years have passed. You may be requested to go to an interview before he receives it just to prove to them that you are actually married and living here together but I have heard of cases where people get it without an interview. You can delay the process two years if you take your time submitting documents but make sure you read everything they send you carefully because many notices inform you that if they do no hear from you within a certain amount of time the case will be discontinued and you will have to reapply. Just to clarify, both the CR-1 and the IR-1 results in Legal Permanent Residence (LPR) Status for the alien spouse.

CR-1 = 2 year conditional green card, the LPR will have to petition for the conditions on the green card to be removed (you file the paperwork up to 90 days before the green card expires, the combined filing fee is currently $590... then wait a few months to hear back from USCIS. From what I've seen, legitimate couples rarely have major problems with this stage. When approved, a 10 year green card will be issued)

IR-1 = 10 unconditional green card, don't have to file to remove conditions

As long as you are married for at least 2 years prior to your arrival in the US, you are entitled to the IR-1, regardless of whether or not it was issued at the interview.

I just learned something new here. My case number starts with MSC as well so Im at the NBC stage. I sent my I130 to Chicago lockbox and Iive in MD. Where is my local office then? USCIS doesnt say alot other than initial review.

The ONLY way to find the location of your file is by calling USCIS and talking with an IO.

USCIS website links will direct you to your local office, but that won't do anything for you unless you confirm it is there.

Caseloads vary from office to office which is why you will see a great disparity in the approval times of 130's
