Dear Friends,

I was sentenced to 1 day on two counts of threatening in year 2001. I was reading the Classes of Aliens Ineligible to Receive Visas at Department of State official website and it said:

'' Multiple criminal convictions.-Any alien convicted of 2 or more offenses (other than purely political offenses), regardless of whether the conviction was in a single trial or whether the offenses arose from a single scheme of misconduct and regardless of whether the offenses involved moral turpitude, for which the aggregate sentences to confinement were 5 years or more is inadmissible.''

I am confused so I posted this message to get some help from friends at VJ. Now this makes me eligible for visa?

well your offenses didnt equal 5 years or more of confinement, so I would say you are OK. They may ask you about this at the interview and be prepared to submit documents about it.

I have read the story of Keith Thomas carefully, Its about drug offences, Its exactly different case.

I-601 will be required, I guarantee that. Dont worry though you will get it through if your relationship is real which I assume it is. Dont worry about it, even though technally you are eligible by there own immigration law writings, they will still deny you. It's another way for USCIS to generate revenue.
