We mailed our (my husband's) adjustment of status, and work permit documents a week ago. His I-94 will expire in about a week. We obviously got married within the 90 days and all. But will there be something for him to show after the 90 days that shows he is legally here? Ive been told he will be "out of status"... which just sounds scary, and is kind of confusing...

Hi there :)

Since you got married within the 90 days and filed for AOS he will not be out of status. Once you get your I 797 C it will be proof that he is adjusting his status and therefore he can stay in the US. Just make sure not to leave the US until he gets his advance parole documents (I131).

Good luck!
