back in US during the process for a k3

Hi everyone

thank you in advance for Your help.

It's 2.30 a.m. here (in France) and I'm totally freaking out.

I'm married since 7th Nov 2012. We start the process in Feb 2013 after I returned in France.

I work in France as a police officer.

My only vacation this year are in one month (in June)

My husband and I are planning my vacation in California.

That Will make 7 months already without seeing him...and I can't imagine to don't see him during my vacation.

Can I back just for one month in US while I'm applying a k3?

I don't want to be in trouble with the police border...so I need Your advice.

I don't think that's illegal to Back for vacation..but I m not sure...

And we also plan to go in Missouri for seeing my parents in law That I adore...my father in law is illy and I want to see him.

I called USCIS about my wife who is from a country on the VWP (Visa Waiver Program). They told me she would be put back on the plane because they cannot prove that she will leave. They can also charge you with VISA fraud and you could not be allowed back for a REALLY long time. This is what they told me.

Yes, you can visit but remember to take plenty of evidence of ties back home (such as a letter from your employer, house renta;/mortgage agreement etc.) and a return flight ticket itinerary. You should show that you're not intending to stay put just yet. :) They can reasonably turn you away if they don't believe you're intending to go home though, that's the main risk, which is why it's useful to travel with evidence rather than just relying on your word.

Frankly, most people pass through with little interrogation from VWP countries.

1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath
