See told you it wouldn't be too long. Bet before Friday your approved. Sounds like your group is moving along quick. 3 rfes out of 6 not so bad which means your up for a straight approval . Sounds to me like they already got the rfes out of the way they just working on the approved files with all the stuff intact. Keeping fingers for you. You still going to be able to travel? You away for long? Hope you have all your other papers and forms sorted cos not long now.

Like you said, I'm hoping they are following some sort of process and now they have gone through the RFEs and started approving it will all be approvals from here on out for my group. Just have to wait and see now!

My NOA1 is May 20th and my A# changed on May 28th. Some in my group have rfe's some approved, some with the receipt of the rfe but it's about 6-7 in my group still in initial review. I am not expecting anything until late August at the earliest. I'm not going to be impatient especially since I had my paperwork done since end of March and didn't file til May...

To be honest all i have been doing so far is downloading DS forms and checked where medical was going to be, found a place to get US passport done. It's not too far from where the medical is going to be done. Ordered my 18 year olds birth certificate. Even though she will not be coming with me just yet they want birth cert of all children. My sons is already a American citizen I gave birth to him last year 2012 so he is good to go with no probs. the dilemma right now is my 18 year old who is going to stay as she is going to university in October to study chemical engineering. It's a 4 year programme so am going to have to phone uk embassy tomorrow to find out if I can still get a k2 visa for her even though she won't be using it right now or if I should just wait to adjust status. I understand k2 is only good for 1 year so kind of weary about that. She will be 21 in 3 years time. I would like her to come join me when she finishes her engineering degree. But the timings a little short before she reaches 21. Am trying to find a solution to this problem. Any ideas about this area of things? Or do I need to call them up and ask them questions.

I don't know much about K2 visas, but if push comes to shove after she graduates, if she wants to immigrate to the US you could always apply for the I-130 for her. The process is a bit longer, but you could always apply for one on her 3rd year at Uni. smile.png Until then she can always come visit for holidays and summer break on the VWP.

Yes that's what we were thinking would be a better solution cos if she took a k2 visa right now she would need to sit in america for a period of time. Not too sure how long that would have to be before she can adjust status. I would rather she finished her degree here in the UK first I just didn't want it to be. Case where we are cutting it fine with the age thing. I guess since i130 allows you to stay in what ever country your at it would be a better option. Do you know anything about adjusting status for me and how that would take? Can I file her i130 once I have my permanent green card? Or do I need to be a citizen first? I tried calling the embassy in the UK today but they really only had the operator who really didn't have a clue so never got very far with the questions. If anyone else knows anything would be great full for the info.

The AoS can take anywhere from 3-8 months or more. I hear it's typically 5-8 months, like with the K1 it depends on processing times for the Service Center, but at least your partner is there with you. After 2 years of being married you can apply to lift conditions unless you're AoS is granted after your 2nd anniversary, then you just get the standard 10 year GC.

As for the I-130:

  1. Any U.S. Citizen or Permanent Resident is an eligible sponsor for the I-130.
  2. The I-130 process can take upwards of a year, this depends on the Service Center.
  3. You will be her sponsor which means you'll have to file an I-864 and meet the income guidelines.

The K2 visa is valid for 6 months once it's been granted. Once she enters the US on a K2, she'll have to file for her AoS, her EAD and her AP (just like you!). Once she has her AP she can leave the country without her AoS being considered "abandoned", but she would have to take time off school to do so and she can still have issues on re-entry.

In this instance I would recommend either delaying Uni for her for 1 year while your sort this out and she gets her AoS done, or going the I-130 route.

In my opinion, the most logical in this instance is the I-130 route, but a veteran VJ'er may have more input.

Thank you so much for the info. I agree with you. The option to take a year out of school wouldn't be good so yes the i130 filed probably in her second year of school is better since it might take about a year I would think by the time 3rd year comes she can probably see if she can do the one year in industry with a US company. Then return back to complete last year of school in the UK. You have been very helpful. I appreciate it thanks. The only other thing to find out. Now is if I am still required to get her medical done even though she won't be takeing on the k2. And since she won't be comeing just yet I would assume she would not need a police cert. what do you think? Hardly seems worth doing all that since she won't be comeing yet.

You would have to check to see if it's required, but I don't think so. The police certification is only valid for a certain time (6 months in most countries) and the Medical is only valid for a year. So both would expire well before you'd need them.

Lol I like that. And too right and yes capitalism is costing all of us a fortune. This process has not been cheap at all. Yes like you said it's hardly worth it since it will all expire before she comes. However I bet someone's going to tell me she needs it just say they can make more money. Oh we'll cant complain still onwards we go. How are you getting on with all the DS forms etc? I downloaded all forms now plodding through them while waiting fon file to be sent to NVC. When do you think we should start harassing them ? I meant calling them lol. To get the new number. Called the Knightsbridge docs they said 2 weeks wait to get a appointment for medical. I was going to wait a week or do need to give them more time lol.

2/14/2014 (day18) biometric appt letter arrived in the mail. Appt schedualled for 2/26/2014 11.00am.

2/18/2014 (day 22) biometrics successful walkin.

4/01/2014 faxed expedite supporting documents to number on letter sent to me. Waiting waiting waiting

4/03/2014 (68 days) EAD and AP approved text message sent status post decision. Hooray !!!

4/7/2014 (72 days ) status change to card in production for EAD.

4/10/2014 ( 75 days) status changed after calling uscis regarding urgency of EAD. Also usps tracking number at 20.580pm

My NOA1 is May 20th and my A# changed on May 28th. Some in my group have rfe's some approved, some with the receipt of the rfe but it's about 6-7 in my group still in initial review. I am not expecting anything until late August at the earliest. I'm not going to be impatient especially since I had my paperwork done since end of March and didn't file til May...

I noticed 5745 got approved from my group on the 30th all others is unchanged. Looks like the California lot are doing may files too. So good news all around. Yes I agree with you. Keep busy it comes when your not expecting it. Mine I believe came as one of the computer updates they made at the weekend when the site went down Sunday. Then by Monday there was a email flashing one my phone. My app then flashed with the Statue of Liberty. Not long for you guys too.

I am just keeping busy. I know it will happen on God's time and not mine. He and I talk daily. I to go and visit him but don't want to waste money we can use for visas and medical.

ohhh..ur a different group from us... i try 400... but its not the k1.. im observing this number this week... WAC#######700 to WAC#######712... 5 people has been approved on july 30... wow.... smile.png

Going to take some time, but if you get really bored. jump the numbers by 100 each time.. You'll see there are loads of numbers with only few days difference in NOA1 dates.

Our application is WACXXXXX99982. Playing arround with the numbers I can actually see why USCIS is getting backlogged from time to time.

Yeah, after tomorrow morning I'm not going to be able to check for a week (got a wedding tomorrow and then on Saturday I'm going off to Scout Camp with my Scouts). Might have to ask Amy to call me or text me if our NOA2 comes through, though I'll be so busy I won't notice!

Lol I like that. And too right and yes capitalism is costing all of us a fortune. This process has not been cheap at all. Yes like you said it's hardly worth it since it will all expire before she comes. However I bet someone's going to tell me she needs it just say they can make more money. Oh we'll cant complain still onwards we go. How are you getting on with all the DS forms etc? I downloaded all forms now plodding through them while waiting fon file to be sent to NVC. When do you think we should start harassing them ? I meant calling them lol. To get the new number. Called the Knightsbridge docs they said 2 weeks wait to get a appointment for medical. I was going to wait a week or do need to give them more time lol.

I used Rapid Visa to prepare my paperwork, so it's all pre-filled out when I answered all their other questions, aside from the DS-156 (which I already filled out). I don't have to worry about much aside from getting my fiance the documents he'll need like my birth certificate and my divorce certificate. I plan on mailing those to him this weekend.

As far as I'm aware you're likely going to want to schedule your medical after you get your number from the NVC. The doctor will need that number when identifying you in his medical report. o.o Might want to call the embassy to find out for sure.
