Hello all,

My wife has (finally) received an invitation for interview in Montreal at the end of June for CR-1 visa. We had already planned a trip in advance and she will be visiting me in the USA during the month of June. She is booked to fly back to Canada from USA on July 1. My question was, is she, by law, allowed to travel from the USA to Montreal for her interview and then return to USA a few days later? Let's say the interview goes well and visa is approved, would she be able to return to the USA or will they keep her passport? My other option is to reschedule the interview for August...

Sorry no, if she is approved they keep the passport. She will have to wait for the visa to be stamped in her passport and returned to her before she could leave again.

On the Montreal Consulate information PDF, there is a line that says:

EXCEPTION: If you currently reside in the U.S. on a non-immigrant visa, you MAY be able to pick up your passport with visa and visa packet at the Consulate in the afternoon of the next business day after your interview. Please note that due to required processing procedures, we cannot guarantee a visa will be ready at a particular time.

I know she will not be residing in the USA, just visiting, but does anyone know if that above exception can be used in that case?
