I-134 at time of interview

Again...I have another question (I am sorry unsure.png )

While preparing for my interview (05-16-13) I am currently holdind a position of Medical Assistant with a salary of $30,720. I have only been there for 1 yr and 2 months. I am a mother of 3 boys (from previous marriage) and I am partially responsible for them according to my court order. On my past 3 year of income taxes, only shows 2 child only because the father claims 1. On the I-134, it asks for me to put down who am I responsible for and if I am wholey responsible or partial? Obviously it's partial. But do I put down just 2 child since my income taxes shows 2? Would I need a co-sponser? And if I do, I have my father who is an LPR who is willing to be my co-sponser. He only claims my mother (no she does not work) and has an asset value of $250k + and his salary that is $40k +. Will it be a problem that I use him, being that he is an LPR and not a Citizen of the US?

I also get Child Support (through mutual agreement not by court) for $400 monthly. Will they need proof of that? I don't recall putting my children in the I-129f packet when I sent it. How do they know if I have any children period?? LOL blush.pnghelpsmilie.gif

I am sooo sorry, I just want everything to be perfect or atleast close to it lol...and everyone in VJ has been so helpful!!

Timeline

You are actually wholly responsible for minor children. Partially for adult ( aka college age) children. It doesn't matter who claims them you count all 3 as wholly responsible. Lying /ommitting fact to immigration is never a good thing , it can backfire horribly. You household size is 5 so you need to make that enough to cover it ( 34362 ? ) or have a co cponsor that does. Your fathers assets would need to be somewhat liquid for him to use assets.

This will not be over quickly. You will not enjoy this.

As already mentioned, all 3 of your minor children are counted in your household size. It does not matter where they live or which parent claims them on their taxes.

You would need to provide a court order for the child support in order for it to be considered as income.

Yes, your father can be a co-sponsor. It can be any USC or LPR. His salary is $40k and you stated the only one in his household count is his wife, so he only needs income enough for a household of 3: himself, spouse and the foreign fiance. His salary alone is enough for a household of 3, so no need to list assets. Along with his I-134, most recent tax transcript, letter from employer and recent pay stub(s), he needs to include a copy of his green card, front and back.

Timeline

As mentioned he makes enough to qualify without assets assuming he never sponsored anyone else. A personal home is not usually allowed as one of the catched is you have to be able to convert your asset to cash without undue harm. If it was a rental it would be usable ( I guess it is ok to put renters on the street but not yourself )

This will not be over quickly. You will not enjoy this.
