bringing spouse to us

hi not sure if this should be in another forum, if so mod please move.

my cousin from vietnam got married last year ( july 05) in vietnam to some guy she just met through a friend of the family. i recently heard from a family member that after they got married she was told (by him) that it would only take 2 years for her to come to the us??

i know that he came to the us sometime in april 02. also i heard that he filed for a spouse petition ( i-30 something) right after he was back in the us? so my question is how is this possbile? ive been doing some research on the internet and found that a) current process time for pernament resident spouse is dec 04 B) the latest he can become a citizen is april 07?

is what he is telling my cousin realistic or just lying to her b/c i don't see it happening at all. i'm just don't want her to really think she will be here next year and being disappointed when she's not.

Once he is a USC the current process time for permanent resident spouse that you mention is no more as he can update his petition to that of a USC. The spouse of a USC is current....There will be no wait time until a visa number is available as there is for a permanent resident. Will she be in the US at the end of the year. You would need to check current wait times for scheduling of interviews but the end of 07 would not be out of the question if he has his citizenship by mid year or soon after I'd say.

i just read somewhere (not on this board) that since he file as a permant resident the service center hasn't process or approve his petition yet? so if this is true when he become a usc, the waiting period would be the same as a person who just file for an i-30 ( like 1 year or whatever?). i really don't understand immigration laws and what not so if my questions seems noob'ish sorry. hehehe

The petition will go through the normal processing, approval etc. One just cant be granted an interview date until a visa number becomes available if one is a LPR. Once he has upgraded his status on the petition a interview can be scheduled. It all depends on what stage the process is up to when he upgrades his status as to how much longer he still has until complete at NVC and forwarded to the consulate/embassy for an interview date to be scheduled. Man, I'm tired, so I hope I just made sense

I believe that a year or three back the USCIS changed it's policy on processing petitions and began holding petitions until the priority date was near rather than processing them and letting the DoS hold them. (A typical governmental way of solving problems - in this case the problem of excessive backlog - push the problem off to the future?)

ohhh, so his petition probably hasne't been approve yet then since the current priority date for lpr is 12/04 and i think he file 08/05? so then once he become a citizen and file to upgrade statues its going to be another year until my cousin gets here?

The visa priority date, not the USCIS processing date (proper terminology is more than a question of semantics). Spouses of LPRs are second priority, group A, 15 March 2002.

When he becomes a citizen he can upgrade the petition to spouse of citizen, for which there is no priority date - visas are immediately available - and his petition can move into the active processing queue at USCIS.
