Lost job, applied to change status and the case is pending. Am I legal?

Well, I lost my job and submitted an application to change my status from worker to tourist.

The case has been pending a while and when I called in, they said it's still processing.

My question is whether or not I'm still considered legal. I've been told that as long as I submitted the application and it's pending, then I'm legal.

I'm thinking about doing MAVNI and one of its requirements is to have been in the US legally for at least a couple of years.

As long as you are waiting for the response you are considered in the legal status but if the request is denied than you start accumulating the overstay from the day you lost your job.

Also you may want to look more in to MAVNI currently it was on hold and they were not recruiting anyone and you might want to check with some Army recruiter as far as I know they only hire USC/LPR or Legal resident.
