Please help me to understand my options if you might:

I am still on payroll at my company even though my time is split between U.S. and Canad for another 5 weeks. They took me off of paying to EI and income tax (just on my last pay) since I'm now a US Permanent Resident. BUT when I make the full move I would like to apply for EI if I can. Can this still work? Will I qualify? I can have them turn the EI payment back on if needed again this week.

Any help would be appreciated!

I know we have a thread on this but I think my situation is a little unique due to my tax status being changed already and still being in the system. My boss is open to helping me however he can so any thoughts from those of you who truly understand this would be most appreciated.

I would think you should still be paying EI. I think you need to have EI insurable earnings while you are still employed in Canada. Otherwise your entitlement would be lower I would think. I know we have to put EI insurable earnings etc on the ROE.

When you are done with your employer they’ll give you your ROE which you use to apply.

My employer and I were going to continue with me being on the payroll because I was going to continue working there but have now changed my mind. So the EI stopped being paid because the employer now has a US permanent resident as a staffer instead of a Canadian. The Canada Pension Plan payments don't stop but EI and income tax do. I'm going to get it switched back so that I can claim the EI in another few weeks. So confusing. But it's taken care of now.

May be best to call the EI people to ensure you are doing it properly and legally

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Everything is set up correctly now. We paid the additional EI on this pay to get it caught up to what did not come off on the last pay. It was only $24.36 so it's not a huge correction but it put everything back to the way it should be.
