Moving back to canada after K-1 Visa in USA

Hi everyone,

I hope im in the right place posting this..

Im currently having some issues... Basically ill give you all a quick rundown:

-I moved to the USA on a k-1 visa March 2012, Ive been living with my husband (who is american) in the USA since moving here.(I moved from Canada im canadian)

-I got my green card in the mail about a month ago (which was weird because I was told I had to go to pittsburg for an interview, but I didnt..they just sent me the card in the mail which was a huge surprise..)

-Me and my husband are having marriage issues (I wont get into them, we have tried working on them but we just arent in any luck) and I want to go back home to Canada and be divorced.

All I want to do is go back home to canada and not be together with my husband anymore...beside the divorce, what steps do I have to take to go back home to live? im so lost..I assume I cant just go across the border to canada and live there now im sure I have to do something and im lost on everything how to go about this..

any help would be EXTREMLY appreciated!!

I'm not too sure what all the steps you need to do are but you probably have to contact USCIS. You can move back as you are still a Canadian citizen with a Canadian passport so you do have a right to return to Canada.

You can just leave. No biggie. You can formally relinquish your GC at the consulate/embassy in Canada at a later date.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You just have to contact the USCIS, but be very sure this what you want before you do. Because once you start the process to close your case, you will have to start it all over again. If you are born Canadian you will always be one.... Good luck..

No need or reason to contact USCIS. She turns the green card over at the border when she crosses and gives up her PR status.

To the OP you can go across whenever you want to with your stuff any time. There is no restriction of any kind. Just hand over your PR card and say you are not planning on returning to the US and are abandoning your PR status.

Moved from K-1 forums to Canada forums as this is not a K-1 process issue but a country specific issue.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

are you canadian citizen? if that's the case your 100% welcome to canada anytime soon...no questions ask!!

anyways are u sure you want to abandon your greencard? anyways u had less than 1 yr to think that if you go back to canada....but make sure to go back here in the US before 1yr since u enter canada.

New or returning residents arriving from outside Canada should contact a private insurance company for coverage during this period.

If I remember correctly you are from BC. You will need to get private health insurance to cover you off for your waiting period. The MSP site recommends applying as soon as you are back in BC rather than wait. http://www.health.gov.bc.ca/msp/infoben/eligible.html

Yes be sure to know that this is what you want. As mentioned already, abandoning the GC will mean just that and once you move to Canada your GC is no longer valid and you are no longer in any status in the US. If so, then yes, just hand it over as you leave the US...

I agree with others here, make sure this is what you want. One of our terrific posters here Saylin went though some hard times with her husband as well, however i believe it was around AOS time for her. Like you she posted and asked for advice etc, and she eventually decided to give it another shot. Now she is renewing her green card and everything seems to be going great.

the Immigration system is not for those faint of heart or for those with no patience. the system itself will wear you down and test your love for each other. If you have already gotten through as much as you have, think long and hard about moving back, its a mistake you don't want to make if you change your mind later. And besides, it DID cost a lot to get where you are already! :P Just kidding, well partially lol :) it was alot of $$$ :P
