Hello there,

Can someone help me with my immigration issue please?

I married to my ex husband 2 years ago. Got my conditional green card and now it's expiring in May 2013.

We ended the marriage before I get to remove conditions on my green card. We have already filed for divorce but it's not finalized yet. I was told I need to wait for the divorce to be finalized to go any further. The problem is my conditional green card is about to expire before that. Is there anything I can do about it?

How do I get the extension ? Am I too late for everything? Will i still be able to get an extension? I know i should have filed it 90 days ago but what should I do now?

My ex husband is already out of the picture. There's no way he will help me with anything. I'm hopeless please help me!!! I'm doing everything alone here.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Since there's less than 90 days until your conditional green card expires, you should file for ROC even though your divorce is not finalized. They will give you some more time to finalize the divorce. Do not wait until after your conditional green card expires; that would be very bad.

1. file for ROC now, clearly stating that you are in the process of getting divorced, note the filing date, noting the supposed final divorce date, all in a cover letter.

2. expect an RFE to show the divorce document, at some point.

HOWEVER - filing is good, as it gets you that 1 year extension letter, and THATS the thing you need.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

If I was you, I would still file. I'd rather be submitting the final divorce decree at some later point rather than facing the automatic removal proceedings that follow for anyone that does not file for ROC.

Take a deep breath, You will be fine :)

Me and my husband divorced. We were married for almost 3 years. I filed a divorce waiver and my interview is in less than 3 weeks.
