NVC Filers - May 2013

Hello everyone.

How likely it is that the embassy will accept the certified copy of Marriage Certificate during interview??? Because while submitting my I130 I sent original one. I didn't know that I can send only copy at that time. I have already file G884 for return of my original documents. It's been more than 60 days but I haven't got anything form USCIS. When I call USCIS, they ask to give them more time and don't know how much time they need. I worried coz I don't have original to show in interview if asked for.

They may have sent it on to the NVC. Is the certified copy from the issuer? If so that is just as valid as the original.

Hi Jenny,

As far as I know the I864a is still the same form (http://www.uscis.gov/files/form/i-864a.pdf)

However, I can not seem to find the old version for you.

If you PM your email address, I can try to find the old version on my PC.

I'm a little concerned about the I-864a form also because this is what is listed on the USCIS website about it:

03/22/13. Previous editions accepted.

The new I-864 was also issued ion the same day.

If they accept old versions do you think it's better to send an old one, incase they are having the same issue?

Does anyone els heave an older version of the I-864a form they can send me?

Yes it is certified from the issuer which I used while submitting my IV package. so my certified copy is now with NVC but I don't know about my original one.

You should be fine with certified marriage certificate, as long as they are from the same issuing authority. I think you have a valid reason to explain during the interview that original was sent to USCIS.

Our case is complete, and when we call NVC, they tell us they are waiting on the Guangzhou consulate to schedule us for an interview? So what happens when we contact the Guangzhou consulate?

They tell us since our case is electronic, the NVC schedules the case. Someone is lying here...

I really don't know what is going on here. We called and asked when our case's final review was completed, and they told us May 15. Yet we did not receive the case complete email until May 22, and it seems usually the email comes before the final review. correct? We've now been waiting over a week since the case complete email and over 2 weeks since (apparently) the final review was completed, and no one has any idea where our case is?

Something's funky, as usually after final review complete, the interview is scheduled 2 to 5 business days after.

I suggest you dig a lot, contact a supervisor, use 'Electronic Processing' in a sentence.

There's a special, hidden, scheduling queue for Guangzhou , it smells like something is busted, at the moment (or at least since the 15th of May). Tell the supervisor you KNOW for a fact that the interviews are continuously scheduled for Guangzhou IV for EP cases and your want to know if that human quit, got fired, or retired.

Then report back.

If I was able to send the AOS package today, should I send the old 864 or the 864? I am doing the electronic processing.

Send the prior version to NVC. Prep the new version also, get it in your spouse's hands for interview day.

Roger that... for anyone else with a lack of easy PC access like myself he sent it out 5/28 and it cleared the bank 5/30.

I sent my AOS fee out 5/29 and it cleared 5/30.

So at least payment-clearing is one part of the process that hasn't seemed to have been affected by the May slowdown.

Hi,

I submitted this proof, only because I claimed it on my U.S. taxes, so it was necessary for the tax return to be complete. It won't count towards income for us, as far as I know foreign income will not count unless it continues from the same source once reaching the U.S. I have a joint sponsor whose income is the important part, however the NVC is giving me a headache about the foreign income in my tax return. I don't believe you can submit any foreign tax forms. If your husband hasn't done his U.S. taxes and has earned under the threshold he can just write a written explanation as to why. The important part is your joint sponsors income.

So you earned a foreign income and submitted that with your AOS packet?

My husband has been at uni for 4 years and only just got back to the states and has a job there now but no IRS or tax documents for the last 3 years obviously. He earned a little in the UK during that time but we didn't submit any US tax returns a)we didn't know he needed too and b) it really wasn't a lot of money, maybe $10,000 per year.

My question is should we just write a letter saying he was out of the country and include something from the tax website saying he didn't need to submit tax forms as he wasn't earning, or should we try to submit the UK tax forms and have that hasstle? Seems like its more trouble than its worth? His dad is a co sponsor and earns well above the poverty line anyway.

Ya, no one has busted the 'we take your monies' part at NVC, yet. Oh wait - I remember some slowdown on reporting it back, to the payment portal on a few folk here already, middle of may or first part of may - where it was 8 to 10 days back on the reporting at the portal after the funds left the bank.

So, instead, I'll posit:

Who knows? The proof is in the reporting date, back at the NVC payment portal, each and everytime.
