Quick leave after marriage

There's nothing in 9FAM that states she HAS to adjust status.

The only reg in 9FAM about the K-1, is that she has to marry within 90 days of arrival.

And that's it.

IMO, the loophole hinges around -> if no adjustment of status, domicile requirements in the I-864 won't matter.

After doing more research on the K-1 Visa, I don't see anything that says we cannot immediately leave after getting the marriage certificate. Everyone's intention almost always is to get married and stay, but I haven't signed anything that says we intend to stay.

If there is anything anyone has read or an experience someone has had that would give reason to believe that we are doing something illegal or have a higher chance of getting denied for this over the tourist visa, please let me know.

It seems like a good idea to go for the SSN for my fiance if we can enter through the K-1 Visa. We have already been this far and spent a lot of time and money.

I thought you did not want to marry in the States.

Think long term ie future trips to the States.

We are fine with getting the marriage certificate. We just don't want to have a ceremony first in the States. We want our first ceremony in China.

Darnell, I've read through the guidelines and everything and so has a friend who is guiding me through it so I don't make another dumb mistake, but what are you specifically referring to?

Apologies - it has a real name, but I rarely use the real name. It's the Foreign Affairs Manual that all Consulate staff use.

The link above handles the sections that covers adjudication of visas, and the K-1 adjudication regs/rules/guidelines are in there.

If my dad and I are both going to fill out the I-134, do I need to include my job in China? There's no place for me to put the country I live in. It just says the address with city and state.

Does my dad need to sign this or can I sign for him? He's in the States and I'm in China. Kind of inconvenient, but he could mail it to me if needed.

Do I need an employer letter from my university I'm teaching at?

Technically, you are unemployed in the USA for 2013. I suggest you fill out the I-134 to reflect that.

I-134 must have original signature.

We want the ceremony/wedding to be in China first, Bayareaguy.

Be careful about that, she can fail the interview or be denied entry if they think you are married.

That I-134 must be original, with his original signature on it.

A FAX will not suffice at the IV unit, sorry.
