No NOA after a monthunsure.png

I started preparing myself for worst case scenario (lost or return) and getting all the paperwork ready again just in case.

My GC will expire in 40 days so I guess I can wait about two weeks and see how it goes:) I hope I will get NOA sometime before that like tomorrow!! haha

Do you guys have any thoughts or suggestions concerning my next step?

I called USCIS and they said my application is not in their system. Check is not cashed (once I said it was, but there was miscommunication with my lawyer and she was the one cashed my check. Oh and I hired her for paperwork preparation, I am responsible for this type of issue.)

wow first and foremost I am sorry for your troubles. Secondly I would be so pissed at that lawyer, they cashed your check but you are not in the system with the USCIS what's up with that? Yes 1 month is too long for a NOA you should've got it by now. Did they even sent it? By the way check your statement depending on where you send the application it should say something like (Vermont Field office bla bla $590) not some lawyer's company name, aside from the fee you paid for the preparation. Do you see that on your bank statement? If yes then you must be in the system with USCIS (coz they create a case number when they do) if not then go yell at your lawyer.

If the check hasn't been cashed yet, then a NOA won't be issued. I'd speak with your lawyer and find out the REAL date they sent it. Ask for proof of mailing. Sounds like they didn't send it when they said they did as one month is too long for the check not to have been cashed yet.

I hope your lawyer handles everything right and took care of all your paperwork that needed to be taken care of :/ .... did u ask your lawyer what's going on?

Thank goodness, it's finally here:-) I have received NOA today dated July 2nd.

Thank you so much for kind suggestions and comments.

As many of you suggested, I talked to lawyer after the post to figure out what's going on.

Looooong story very short, when my lawyer called USCIS today (before NOA came in mail), USCIS officer told her that my name is in the system (yay!) but could not give her any further information about my case since the form G-28, Notice of Entry of Appearance as Attorney that she filled is expired and she has no right to speak on my behalf.

#######, right? I strongly believe the expired form caused delay in the process, and it took them over a month to issue NOA.

So tired of dealing with it but happy with outcome that USCIS decided to keep my application at least instead of sending them back with damned expired G-28! hahaha

At the end of the day, I still consider myself as May filer:)

First off, grats on FINALLY get the NOA in the mail! kicking.gif

Since the NOA is dated for July, you should switch to the July group as that's the group you're with now. Although you technically "filed" in May, your NOA date is for July, and that's what matters in this process. Like the other member from a few weeks ago, I'll have to take you off the May list. Sorry :(

Looks like they're beginning to process March submissions. Hope that means we'll start to hear good news in September!

Really? Cause looking at Igor's List, there's only been one March "approval" (I'm very questionable about this approval as they got their NOA2 before their NOA1, and the NOA2 is dated the day after they sent their petition, so I think something is amiss there).

If there have been March approvals, then these folks need to update their timelines headbonk.gif

I haven't had any touches either since May 10th.

For my I-130 petition back during the visa process, I never had gotten a touch, so I'm not really expecting much this time laughing.gif
