Don't you have to live in a state for at least a year to establish domicile in that state to support your residency in that state? It sounds too easy to move to a state where first cousin marriage is permitted and get a lease and drivers license and then file the K1.

Hello,

I'm looking for your input regarding my situation. Im a US citizen and I married my first cousin a year and a half ago. We applied and worked our way through the K3 visa. Two days ago my wife interviewed in Jerusalem, and after the interview she was given a refusal letter stating that we must live in a state other than Texas that allows first cousin marriage.

From my humble knowledge, first cousin marriages are not allowed to take place in Texas. But, Texas accepts those marriages that occurred outside. Our marriage is legal back home.

What should we do? Please help as this is very devastating for both of us.

Thanks for your reply. Yes she interviewed for a k3 visa per her interview papers.

On another note, can one argue the legality of the case? I mean Texas does recognize cousin marriages that occur outside the state and don't void it.

You can't fight it.

As long as you are a resident of Texas, you are subjected to the law that said residents cannot legally marry 1st cousins. This law does not apply to non-residents who marry and later move to Texas.

You really need to move to a state that does allow 1st cousin marriage to bring your wife to the US.

I have a question. Why would you tell them that you guys are first cousins?

If you didn't tell, how would they know that?

They are required to disclose they are 1st cousins. The question is on the petition.

They will know because of the background check.

Nope. Domicile starts the moment you move to a new resident with the intent to make it your permanent home.

In your example, the moment the lease starts and the person moves in, he has established domicile.
