Timeline

I have one question. I got an RFE this last Saturday as my wife cannot meet the Poverty Guidelines. Her brother is willing to help to be the joint sponsor. He as of now has not filed his 2012 taxes and he is going to do it this Monday. I talked to the lady that is doing the taxes for him and I explained her my situation about the sponsor requirements for the I864. She gave me options on how to file the 1040 which, my wife's brother has 2 dependents and he had 2 jobs last year. He only has one job this year but the lady said that if we need to meet the 125%, she could just add 1 dependent on his taxes to meet the requirement and amend my taxes as soon as I get my SSN and add the other dependent to mine. Do you think this could be an appropriate practice or should we get in trouble? We have no doubt that he meets the requirements for last year even with 2 dependents as he had 2 jobs. But this year he only has 1 job.
