Hi all,

I am planning to file an adjustment of status from a valid and current F-1 visa that will expire in late 2014.

I understand that should not be a problem, if we file all the paperwork, pay a hefty fee and make sure I stay in the US

for the duration of the process.

1) Since my F-1 visa would be terminated, does it mean I will not be able to continue my studies?

2) I am doing a Phd at a top school with an intent of obtaining a faculty position in biomedical engineer.

I think I am on a good track too. Would obtaining a green card through marriage on F-1 visa cause

any trouble? I could possibly apply using NIW once I get my Phd next year, would that be a better

idea (I am assuming not, but I am trying to make sure)?

Details:

- we've been dating for 5 years, engaged for 1; went to college together, got bunch of records together. She went to medical school in a different state

than my Phd school, but we are moving back together this month. We are getting married a month later.

- We both have jobs (grad school stipend and a medical residency) and we should fit in above the minimum requirements, starting july 1st.

Your f1 does not end until your gc process is complete. You may continue your studies. If you want to travel during the process make sure you apply for advanced parole. Good luck

5.13.13 Day 32 RFE Hardcopy received (Tax return for JS and Computerized copy of my BC)

5.23.13 Day 42 RFE Response mailed off to Lee's Summit

5.28.13 Day 47 RFE Package delivered to Lee's Summit

5.31.13 Day 50 I-485 status updated to RFE review

6.4.13 Day 56 Biometrics background check came back clear to USCIS (got this from L2 cust serv)

6.11.13 Day 64 I-485 updated to Testing and Interview (email notification)

6.17.13 Day 70 Faxed a request to NBC to Expedite EAD

6.17.13 Day 70 I-765 updated to Card/Document production

6.19.13 Day 72 Email notification, interview scheduled for July 24th

6.20.13 Day 73 I-765 updated to Card/Document production (2nd Email)

6.21.13 Day 74 I-765 Email notification, Card mailed (no tracking)

6.24.13 Day 77 EAD arrives in mail

7.24.13 Day 107 Interview!!! APPROVED ON THE SPOT

8.02.13 Day 116 Green Card arrived

Goodbar gave you a good reply. I was on F1 visa that would've ended on 2014, and no, you are on F1 up until the day you get approved, get your green card and go to your local international adviser and tell him/her that you have adjusted your status. He/she will make a photo copy of your green card for documentation and terminate your SEVIS record. So, no worries, you'll be an F1 visa up until you are not approved and walk over to your international adviser. Nothing to worry. But, make sure you register as a full time student in the meanwhile to maintain your "F1 visa status". You don't want to have any complications while your AOS is in the process already. And in terms of your dating, I was also dating my partner for 5 years, so basically the interview was a breeze, show me your passport, the usual criminal/prostitute/terrorism questions from the form, and when we met. Then we should our photo album where we basically just chitchatted about who is who, where were we on the actual photo etc. Then or IO did not even ask for bank statements, lease agreements, joint insurances etc. at all, but approved us on the spot, and by the time we reached home (2 hour drive) USCIS website already updated their webpage and were saying that I was accepted for permanent residency. Then about two days I've got the NOA, and about a week my actual green card came in the mail. So, really! No worries! You'll be totally fine, and just going to be a happy F1 student until your approval. :)

You remain on F1 "status" meaning you can still go to school, but you will no longer have an F-1 visa, meaning you cannot travel like before - you need Advance Parole to be able to travel internationally.
