Expediting Interview in Montreal

Hi, this is our first time posting... We are getting very anxious at the moment. Daniel is USC and I am Malaysian. We both live in Canada right now and have just received our NOA2 after 7+ months. I am on a student visa here in Canada and will be graduating in June, when my student visa will also expire. We are wondering is my visa expiring considered grounds for expediting the interview in Montreal? How do we go about doing this and does anyone know how best to ensure we get the interview expedited? I know everyone would get their visa expedited if they could, but we submitted the I-129 as soon as we could, and the processing times when we started was 5 months and it got extended to 7.5 months betweeen NOA1 and NOA2. so now we got thrown off the original schedule. I would need to go home to Malaysia upon expiry of my Canadian study permit and we're afraid that is going to complicate our whole application process. Help! :(

If you have your NOA2 you'll need to contact NVC first to get it out of there, then contact the Montreal consulate to expidite there.

The USC will have to establish or re-establish domicile in the US prior to getting you a visa, please go on over to the Canadian regional forum to discuss this

I'm almost certain your case would not fall within the very narrow grounds for granting expedite. At the moment, you are not at NVC stage so it's not difficult to change embassies. The NVC will decide which embassy you have your interview and when. If NVC assigns you a Montreal case number, and you happen to be in Malaysia, email NVC with a copy of the front page of your passport and request that your case be re-assigned to the Kuala Lumpur embassy.

The same thing happened to me. NVC assigned me to London but by the time my case reached NVC, I had decided to move to Malaysia to spend time with my parents. I emailed NVC to ask for the change and they did it within 10 working days.

I should note that I am doing a CR-1 visa rather than a K-1 so hopefully a K-1 person will respond.

I'm afraid you will need to wait for your NOA2, but in the meantime, if you change addresses, notify USCIS/NVC (depending on where your case is) to request a change of consulate.

Whoops sorry, mis-read your post. So you do have your NOA2. I guess you will just need to hang on tight until NVC assigns you your case number!

It's not grounds for an official expedite but some consulates are willing to be flexible if you are- ie once the case is at the embassy, contact them, explain the situation and let them know that you are available at short notice if they get a cancelation.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
