I-864 twice...AP ??

Hello guys,

I stated yesterday that i was put in an AP in my interview yesterday and the consular officer asked me to get another Sponsor and told me that he needs to fill I-864 only, not I-864A and he reassured me..anyways...Thats how my AOS was like

Wife: not employed

Step son: 18.000$ (i-864A), He didn't file for tax 2012 because he had his job at the end of the year.also not he has his Tax resturns. (I didn't have it at the interview)

Step daughter's fiancee : 22.000$ ( I had his tax return)

now the questions are :

1- Could my step daughter's son sponsor me alone also he has a daughter ?

2-Why does the CO want a sponsor with I-864 and not I-864A?

Btw i would like to say thanks for the CO for being nice to me at the interview..it was long but he was a polite respectful patient person :)

Also, who is the petitioner and beneficiary? To answer your question, I-864 is often completed the primary petitioner. So, what was submitted to the CO? The more detail about your situation, the more accurate the answer.

1/18/2013 - Married

3/5/2013 - Filed AOS, EAD & AP

3/7/2013 - USCIS Chicago rec'd applications

3/12/2013 - USCIS sends NOA1 email

Give people enough time to respond. Also, it would be nice to get your timeline updated. It helps a lot of the people determine at what stage you are in already.

Also, who is the petitioner and beneficiary? To answer your question, I-864 is often completed the primary petitioner. So, what was submitted to the CO? The more detail about your situation, the more accurate the answer.

I'm the beneficiary, I had my interview for my CR1/IR1 visa yesterday....my wife as i stated previously couldn't sponsor me because she is unemployed...She submitted I-864 and Tax...her son (my step son) submitted I-864A...her daughters fiancee ( I-864)and Tax.

1. Do you mean your step daughter's fiance? You don;t mention a son above... if you mean the fiance then no, because he'd need to make enough for three people (himself, his daughter and you).

2. Because the I-864 is for household members, and that does not mean people who just happen to be living together or just happen to be family- they need to be financially dependant on one another. Only household members can combine income via a I-864A- all other joint sponsors must file a I-864 and qualify on their own.

So for example if the step daughter and her fiance were married and filing taxes together, one of them could file a I-864 and the other a I-864A to combine their incomes.

Yes my step daughters fiance. They are not married and his fiancee (my step daughter ) isn't listen on his taxes.Only his daughter ( my grand daughter) is.

so it should be 3 including me..right? ...if so and he makes 22k ...is that enough to sponsor me alone? also he filled I-884 only.

Awwwh...Okie then, My wife just told me that he was doing an extra work and he made 24.508 on his TAX..but the letter from his work says 22.000 only.so which one should i count..the tax or the job letter?

What counts is current and ongoing income. Is the extra money bonuses that are uncertain, or a recent promotion? To be honest, being less than a hundred over will make it doubtful he'd be approved as co-sponsor anyways.

What counts is current and ongoing income. Is the extra money bonuses that are uncertain, or a recent promotion? To be honest, being less than a hundred over will make it doubtful he'd be approved as co-sponsor anyways.

ohhh i understand now but i have a question, will the new sponsor add up to the current one that makes 22k or not ?
