My husband is a Canadian citizen who is out of status.

He: originally came here on a working visa in 2006

Returned to Canada 12/2007

Re-entered as a visitor in 02/2008 (not planning to stay)

Stayed longer then he was suppose to

Met me (2009), dated for 3 years , married 10/01/2012

Now trying to figure this all out!

We are filing the I-465/I-131 and I-765 together. Most of my questions I have been able to answer through other threads but I am stuck on the I-765. This is what he has for documentaion:

an expired i-94 (not from his last entrance), a notice of action, a I797c and I-797A (all from his previous petition for non-immigrant worker). The notice of action I-797A was approved as a class TN1 valid from 04/2007-04/2008. It is the most recent documentation.

Do I use this notice to fill out the form?

For which is he applying should I check renewal?

ON question 16 the code I used was C9.

For Q11 should I say yes? He does not know where he applied but the I-797a has an address for immigration and naturalization. Do I use this address?

Do I use the dates listed?

Does the TN1 visa even matter since he left and then came back as a visitor?

I am starting to feel very overwhelmed at all this. The I-131 was easy but his paperwork is proving to be a challenge since he does not know alot the information. I apologize in advance if I posted in the wrong forum. Thank you for any input.

Moved from working & traveling during immigration to adjustment of status from work student tourist as this is not a work & travel question but an actual filing question.
