Calling Each Other Husband and Wife

We just have our NOA2 - woo hoo - after almost 9 months and are finishing up what paperwork we need for the next stage.

I have a bit of a concern about printing out the evidence of our continuing relationship. For the last year, we have called each other 'husband' and 'wife' in all our e-mails. We are not married but we feel like we are. I have heard that if the embassy suspect that we may be married, we will be denied as my fiance has petitioned for the K1. We have lots of other evidence of our continuing relationship since filing - I will have spent a total of 8 months in the US between filing and the interview. Should I focus on that and the Skype logs of our video chats? I don't think I will be able to find a single e-mail between us that doesn't say husband/wife.

Had I realized earlier that this might be a potential hazard, we would have thought twice about calling each other 'husband' and 'wife'.

You don't need to include the emails. Just include the proof you have that doesn't have you referring to each other as 'husband and wife'.

Agreed, DO NOT send in any of that evidence. AND.....stop misrepresenting yourselves....you are not married yet and therefore shouldn't be speaking like you were.

Wow yeah, it doesn't sound like a good idea at all to use the words husband and wife. Just like in an earlier thread where somebody wanted to have a non-legally binding wedding, all it can do is confuse the people who have your future in their hands. And what happens if she slips during the interview, "well, my husband, he..." Yikes!

Good news. London is not going to want to see one shred of evidence of an ongoing relationship. Throw the emails in the bin. About your visits. There is no written law or rule that says how long you can visit in a years's time that would make you ineligible for a visa. If CBP let's you in and you leave by 90 days so not to overstay the visit, then you have done nothing wrong.

I was actually curious to see if London would actually WANT to see this type of evidence. In Colombia, which I imagine is a little more skeptical than the UK, they never asked me for ANY evidence. I brought a huge packet of evidence with me, they never asked for it.

I believe that this has been discussed before and the concensus was no do not refer yourself to what you are not and then there is no confusion. The govt sees things as only one or the other and not what is the possibility.

For most who go through London, they don't request to see any relationship evidence, but there was at least once case on VJ last fall where the embassy gave him a 221(g) and asked for more evidence. (And he was a British-born white guy, so not someone from another region living in the UK.) So while for the majority, it's never asked, there's always the possibility that it will be. Thus, err on the side of caution, regardless of the embassy/consulate involved.

They do know. When I entered this time, the officer at passport control said 'I see you stayed the whole 90 days last time'.

I think I will err on the side of caution and use other evidence.

That's odd, because when she came a few weeks ago, they asked her about it because there were no return stamps in her passport. Maybe she just got a rookie agent that day. Odd though because that was also the only time she was actually pulled aside and asked secondary questions. You'd think they'd have more experienced agents in the secondary area.

For others (non-UK interviewees) who are reading: This question comes up too often, and there are several threads about it. For I-129F petitioners/K-1 interviewees to refer to themselves as "husband" & "wife" is similar to loading a 6-shooter with 6 bullets, putting the gun to one's head, and firing. Avoid giving anybody -- at USCIS or the consulate/embassy -- any reason to deny the petition or refuse the visa.

I have been super-careful with that. On the other hand, I don't think I have been careful enough to refer to my fiancee's kids as my "future step-kids pending the marriage to my fiancee which has not yet occurred but will within 90 days of entry." I wonder if that's a problem too, calling them "my kids" or "our kids"

Stamped or not, all passports are swiped on both entry and exit. CBP has this information in the system.

Oh I know she has to swipe it when entering the UK, and it's all entered into their system, but that particular border agent (it was in Seattle) earlier this month hadn't a clue on the length of her visits. Maybe there was an issue with the computer systems at the time, maybe it was a new agent who didn't quite understand how to check it. I really can't explain it, I can only pass on the experience as it happened.
