Hello VJers,

I filed I 130 for my hubby from overseas, mailed it to my parents in March, and received NOA1 via text email March 11.Hard copy received Mar 29.

However the check was unfortunately drawn on a joint account with my parents which had closed due to dormancy and my parents overlooked the fact. How i came to know this is Bank sent a letter around march 15th informing there was an attempt to draw a check but it was declined due to inactive account. They also confirmed the account could not be re-instated.

I was thinking of re-sending the whole I 130 package as I read here and other places they either reject the packet back to the sender or trash it.

But they sent a letter to my parents address around march 25th saying the payment could be made via CC(calling Pay.gov) or by another check.Since paying by card is fast my dad paid it through his CC the same day and it shows up in his billed statement.

I received NOA1 hard copy at my foreign address March 31 here although i had asked them in the cover letter to send all notifications to my parents US address. The NOA1 hard copy has a PD of march 8, 2013.Obviously the letter was sent even before the payment through my dad's card was processed as it was mailed out on March 11 according to the stamp on the envelope.does this mean they process and issue receipt # even without any payment? i know nobody would eventually not pay up for I 130 ofcourse!! but i am just curious..

Now its almost a month plus since mar 8th, and the case status for my recpt MSCXXX does not show up online, should i be worried? does it retain the Mar 08 PD or is it reset? do they issue another receipt #?

Thanks,

Cases frequently take a month or two to shop up in case status online. Mine took over two months and there was not a single thing wrong with it. Since your payment was made and credited, that is not causing the problem. It is probably just USCIS not entering cases into the system as usual. You will probably not get any communication by mail about the case unless they need something from you or it is approved. Unless you hear differently, you should retain your March 8 date. It is always OK to call the USCIS and ask them to make sure your case is in the system.

Thanks,

my case didn't show up online until it was approved.. totally normal these days, but the good thing is that if you call you have to speak to an IO, because the cr can only see what you can see .. which is nothing

I have an interesting tangent to my case, i have 2 MSC #'s one that i originally received NOA1 to my foreign address that was not showing up online till yest may 3.

the other MSC# was on the how to pay my parents received on Mar 26, 2013.

So yest they updated my MSC# on NOA1 first saying they received the "correct" payment filing fee, few hours later they updated the page with:

On May 3, 2013 we sent you a notice that the processing of your I 130 has been suspended because the bank notified us that there were insufficient funds in your account to cover the filing fee.You must wait to receive this Check Deficiency Notice in the mail explaing the steps you must take to return your case to processing.....

the other MSC # on the letter that my parents received on how to pay by MO, Check , CC for the filing of I 130 has another number. This one shows online as:

On April 12, 2013 a change was made to your receipt notice for the filing of your I1485 application to register for Permanent residence or to adjust status. This notice contains specific information regarding the processing of your case.

What does this mean? i filed for i 130 for my spouse and its showing I 1485? im gonna call them tomorrow but this is just sooo weird.

any one else here even seen something like this before? just wondering...

i thought the check deficiency note was the one we received on march 26, and we paid it the same day....

make sense they closed the first MSC# but why does the second MSC show a different form filed request?

Also the MSC #1 has a higher numerical value than MSC #2, i thought they are usually sequential as in the first MSC would fall before MSC 2 in terms of numbers...

i hope they havent messed up my i 130!

The number sequence is irrelevant in terms of processing order. They might not have even been processed by the same people, which could explain the two different dispositions. Call and see what you can find out.
