Citizenship for my wife and 2!step kid

Dear all,

I need your help in completing my wife and 2 step kids citizenship.

Am a born US citizen married to my African queen in 2010 she got her two years green card in 08/01/2010 and she had her conditional removed.

When should I apply for citizenship for my wife.

and my two step kids got their conditional two years green card 09/03/2011. How do I apply for my step kids citizenship and what document and fee do I need for my step kids.

Do I have to file for wife and step kids together? If yes what document do I need to use for the kids and how much for the kids.

I no that for my wife I have to file the form N 400 and I also no the amount for my wife but am lost on how and when to add the kids

Thx as I await your advice on how to file for citizenship for my wife and the two kids.

your wife can file for citizen after 08/2013. She would have been married to you for three years after she arrives. I think the kids will automatic get there citizenship when ever the moms becomes a citizen (my opinion not a fact)

The minor kids get their citizenship after their mom gets hers but she has to apply for certificate of citizenship for them if i am not mistaken.

09/15/2012: Got Married
09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK


N-400: (3 months and 12 days)
Filed N-400 : 2011-06-17
Interview: 2011-09-27
Oath Ceremony: 2011-09-30

IR-5 for Mom Entire process took 5 months exactly
USCIS (22days)

mailed I-130 : 2011-09-30
NOA 1: 2011-10-03 (text & email)
NOA 2: 2011-10-25 (text and email)
NVC: (19 days)
Case entered and # assigned: 2011-11-18
NVC Case COMPLETED: 2011-12-07 ( 43 days from NOA 2 and 65 days from NOA 1)
Interview Date(Lagos): 2012-01- 23
Mom was late for interview
New Interview date: 2012-02-29 : VISA APPROVED

If your wife got the green card on 08/01/2010, that means bases on marriage to you she is eligible for citizenship on 08/01/2013 but since USCIS gives you 90 day period. you can apply 90 days before 08/01/2013. Your step kids if they are less than 18 will be automatically US citizens once she is a citizen. You have to wait for her approval to get their certificate of citizenship. Good luck

Only file one N-400, her kids will be listed on it. Yes, if under 18, and as green card holders, they will automatically become US citizens when your wife does. But with one minor catch, without any proof.

It's not like that I-751 where you got by with an extra 80 bucks per kid, if you want to completely close the door with that I-864 in case your job is moved to China, will apply for an N-600, this will cost you 600 bucks per kid and take another six or so months.

Some just apply of US passports as proof of US citizenship, but then dealing with the DOS instead that does not completely close the door with the USCIS. Then if the kids are under 16 and a biological father is involved, will want permission from that guy before they will issue a US passport.

They get you one way or the other.

Thank you all. My kids are below the ages of 10 and they should be due for removal of conditional on their green card by June looking at the 90days window period. But if my kids wait until my wife get her citizenship then their green card will expire.

Nick D please can you explain what u mean by (one minor catch, without any proof) we just had one child last month. Is that the proof you are talking about

It means they will automatically become citizens same day as her but with no paperwork issued to them to show it. So to get the paperwork , you either apply for certifcate of citizenship for them which costs the amnt mentioned( and it takes months) or US passport ( not sure abt the part with biological father and consent).

If your wife's three year marriage anniversary after green card entry is in aug then her 90 day window opens before then too. she should use the calculator and find out the earliest she is eligible to apply ( which shd be abt May? and go for it.

if she was married before she arrived and got her green card on 08/01/2010 then her earliest filing date is NEXT WEEK!!! 05/03/2013. Double check the dates you mentioned as you CANNOT submit the application even one day earlier. Your kids should be fine then if she starts the process about that time(even if its not completed by their own expiry date of september). see link on how to calculate:
