Conviction

When I sent the I-129F in I did not check any box say I had a conviction because I did not see where my confiction met the regirements they had. However, I have read in some places that soliciting a prostitute should be included. I have no problem reporting it, because it happened a long time ago and I have made every step to not repeat. I have expunged from my record also. Does any know for sure? If I do have to submit, what documents do I need. I have my expungement paper, but that is it. Thanks

Green Card Arrived: August 10, 2009

You should consult an attorney. Show the attorney your I-129F form also.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Sexual Exploitation is something that is listed in part B of the intructions for crimes included in IMBRA. Whether or not your crime is concidered exploitation is something you'll have to research. I did a qucik google search under "Sexual Exploitation Definition" and personaly found that it would be. The fact that it has been expunged does not matter, you still need to include it.

No sense in worrying about it now, you've already sent the application in. They run name checks and all of that good stuff so it may come up or not. The USCIS takes into concideration seriousness of a crime and whether or not to disclose the information to the beneficiary. That's what the law is all about, protecting the beneficiary from a harmful situation. They weigh the crime out and decide whether or not to disclose the information. They can disclose anything that you send or that is found through name checks, so I wouldn't worry about it now. What's done is done and you can't send extra information. Wait and see what happens. you may get a denial or an RFE.

I don't think you'll have a problem personally. but remember I'm not a lawyer!!

Good Luck!!
