RFE after almost 1 year...

I contacted my Congressmans office last Friday for help with my case.

They emailed me today with this response that they(the congressmans office) got from USCIS.

Hi xxxxxx,

On 4/19/2013, a Request for Additional Evidence was sent to the applicant’s address of record.

You may advise your constituent to comply with the instructions on the notice and mail in the response to the address provided on the RFE. The response must be received by the date provided on the notice to be considered a timely response. Upon receipt of the evidence requested, the petition will be adjudicated accordingly.

I really have no clue as to what they want!?

I went over that packet again and again and again, before I sent it. My EAD/AP was approved without any issues!

I just don't know!

Well, someone is looking at your case.

They are supposed to get all RFEs in the first round, but sometimes they miss some. Might be a problem with the medical. Did you send in the vaccination transcription on I-693 from a Civil Surgeon?

I TOLD you the instant you sent out your replacement EAD you'd get some action on the I-485! hahahaha

Ya, all my vaccination stuff was sent in. Medical report, etc.

Hopefully I get the letter soon, so I know what I have to do!

Soooooooooooo....

I received my RFE! Below is basically, word-for-word, what I got.

I-693 Report of Medical Examination and Vaccination Record

NOTE: A review if the record indicates that you entered the United States pursuant of a valid K-1 nonimmigration visa. All USCIS records relating to you have been reviewed. The US Department of State medical forms DS-2053, DS-3024, DS-3025 and DS-3026 were not forwarded by the Department of State.

Please submit a properly completed and signed Form I-693, Report of Medical Examination and Vaccination Record. The medical examination must be conducted by a physician who is on the list of Civil Surgeons approved by USCIS.

-All medical examinations and vaccinatinos must be conducted and administered by a physician who is on the list of Civil Surgeons approved by USCIS. (this goes on to say how to find that list)

-All medical examinations must be submitted in an unopened envelope that has been sealed by the Civil Surgeon.

I just want to point out that I 100% sent this when I first applied... But, did it expire!? Is that why they are sending me an RFE for another!?

ALSO, is this something that can be done in a day!? Or, do I have to wait for bloodwork to come back???

My prediction came true, wow.

Well, it sounds like they lost your medical (though the language is a little different than what I have seen).

That does suck, for sure...

The best list is at uscis.gov

Try to get a new medical at around $200. I have even seen $150; call around and ask. Good luck.

Such #######, but yes it appears they lost your paperwork and will now require you to get a new medical. Completely sucks, but not sure what else you can do. Pretty pathetic that they sat on it that long, and THEN send that.

regarding the time frames for medical stuff, you can most probably get it all completed within a couple of days, I recently had to do the same, once you have your initial medical with a civil surgeon they will take a skin test for tb which takes 48 hours to show and most walk in clinics can do blood work for a low fee and have the results mailed over to the civil surgeon within 24 hours, so yeah, from the initial visit to the surgeon if you do things quickly you can easily have it done in a couple of days.

Not so sure they lost it, but more like they didn't have a good form letter to say "we're so freakin' slow that your medical expired", so used one that said get a medical exam. Close enough as far as they were concerned. They can't approve without a valid medical. Lost or just expired, either way, would require a new exam. Edited by Nich-Nick

I think the date the AOS was submitted is the go-by date for the medical, as if the date is frozen, sort of like the "insufficient time between doses" checkbox - if they wait 3 months more they don't send the medical back and say get the shot...

I can't imagine that when AOS used take years that everyone had to do a new medical, but I don't know. When you did AOS did it normally take a long time?

Well, the medical might have expired since the initial I485 filing. But it hadn't expired at the time of submitting AOS. As far as I know, they go by the validity of the medical exam at the time of submitting it with AOS. Please correct me if I'm wrong(if I am wrong, my medical would've expired before I got my greencard, btw, but after submitting AOS papers).

Sometimes, you're lucky if the panel physician from your home country happens to have a complete copy. In such case, it'll be cheaper(however a bit slower) to request a copy of your original exam rather than go pay 200-and-something dollars for a full exam.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Our AOS was 5.5 months transferred to CSC, while those with interviews were getting done faster.

I guess I was thinking of a visa case recently where the AP delayed them and they had to get medical clearance again. There is also some new wording about cases pending AOS that are adjudicated before Jan 1, 2013, a medical signed more than a year before was, by policy, accepted. Also said the policy was in effect only until Jan 1, 2013. Kinda curious if that was a change in the wind. It's in the AFM.

But there was this memorandum in Dec 2012 with:

In a policy memorandum dated December 29, 2011, USCIS extended the validity period of the civil surgeon endorsement on Form I-693 until the underlying adjustment of status or temporary residence application could be adjudicated. This policy was issued in consultation with the Centers for Disease Control and Prevention (CDC) and it was limited to those applications where no Class A or Class B medical condition, other than a Class B condition annotated in the Other Medical Conditions section, was certified. This policy is in effect until January 1, 2013.

It goes on to basically extend that 1-1-2013 policy change until Sept 30, 2013. So you are right, the older medical policy should still be in effect for five more months. Gotta wonder if the worker bees at USCIS are keeping up with the rules.

Ok Widsy97 you have both good and bad news. I will tell you cause I just had this exact experiance. Waitied 9 months nothing happend and received my RFE for the vaccination supplement. I bit the bullet paid $200 redid the entire medical exam. Sent it to the NBC.

Now the good news. They received my medical papers and the green card was approved in 4 DAYS.

IF i were you I would not skimp and just redo the whole thing guarentess no more problems.

Remember the USCIS is here to take all your money and ring you dry! Indeed you are the immigrant trying to do things the COREECT WAY!
