So that means that if all the applications are in my married name the green card will be too ?? ... I was under the impression that the green card would be in the name on the visa, and the visa must be the same as the name on the passport that it is in...

I am not an expert on the CR1 visa but my logic is--

  1. Two people get married. She takes on his name.
  2. He sends a petition for his wife (who has a new last name). Her name on the petition is her married name. Her maiden name is listed anywhere "other names used" is requested. The marriage certificate shows how/why the name changed.
  3. At the NVC, the DS-230 is the visa application. She applies using her current new married name.
  4. The visa is issued in the name on the application.
  5. After POE, the greencard is issued to the name on the visa application.

If she didn't want her married name on her greencard, then she could use her maiden name on the applications. Then in the US, she might get a bank account and driver's license and tell the neighbors her last name is his, but her greencard won't reflect the name she uses. It will cost $450 to get her Married name on her greencard once it has been issued. Many people continue to use their foreign passport ( with maiden name) until is is due to expire. Again, the marriage certificate is a legal document to show the name change if ever asked.

I'm getting my passport changed to my married name(I'm from the UK too !) because I read somewhere on here that the green card etc would be given with the name on the passport used for the visa (and I didnt want to have to go through getting in changed over there).... if she does decide to get a new passport the UK is not too bad normal service is about 4wks and fast track service is 1 week so if you do it asap she will have it in hand before the NVC gets started on your paper work :) ... Congrats on the approval !! and good luck

Thanks ... got the NOA2 hard copy on the 13th ... but NVC are still saying they haven't received the file yet :(,

I've got so many other things going on right now though so I'm just pushing this to the back of my mind and not stressing.

Someone please help me. I'm really upset at what i saw today. My Wife came to US immediately after our wedding and left back to UK 2 weeks after. The I130 Approval form i received said it has been approved but shows that the beneficiary is living in US too. I didnt have this on the form when i sent it to them and I don't know why they think she's here when she's obviously in UK.

I'm really upset , what Can I do please

thank you, I have to say I was totally floored when I saw I was approved smile.gif.. no onto the next confusion lol

your office unfortunately doesn't look all that great, but at least you are coming up on your 3 month mark. I went down for an infopass to confirm my file was there and see how they were doing.. not that it had anything to do with it, but I was approved less than a week later. either way, I highly recommend the infopass, it was very informative
