Been browsing the forums for a bit while the wife and I filled out her I-485 and accompanying paperwork but.....

We just received our packet back with four I-797c forms for "Incorrect check amount" attached onto the I-485, I-131, I-765 & I-130 forms. I can't tell if I'm just an idiot at math and added the fees incorrectly but I can't find where we've messed up? The total amount I came up with was $1,625 written in a single check to the Department of Homeland Security.

I've attached our cover page that lists exactly what we are applying for and the fees associated with them. Can anyone have a look and tell me what I am missing? I've looked it over so much but I feel my eyes are missing something.

Also note that we didn't include the fee associated with the I-765 as I believe sine 2007 it hasn't been required as long as it accompanies the I-485.

Please let me know if I can provide any further information. As I'm sure like most we are running up to the end of her visa and need to get this right!

are you applying for AOS for K1?

if yes, you don't need to send form I-130 plus you send a wrong amount ($1070).

I-765 and I-131 is FREE when applying for I-485.

We've already been married (12.29.12) so we didn't apply for the K1.

Do you think by including the fees associated with the I-765 & I-131 my check amount being too much caused the rejection?

The I-131 is also free if sent with the I-485 AOS application, do scratch that.

You don't have a timeline so I can't tell what you are adjusting from. Most in this forum are from K1. If you are indeed K1, then no I-130 is needed, thus no fee.

K-1 AOS is $1070.

If you are adjusting from a work, student, tourist visa, or VWP, then there is another forum especially for that. That would require an I-130.

You don't have a timeline so I can't tell what you are adjusting from. Most in this forum are from K1. If you are indeed K1, then no I-130 is needed, thus no fee.

My wife is currently adjusting from a B1 tourist visa of which we did include the I-130.

Then your fees are

I-485 = $985

Biometrics = $85

I-130 = $420

I think the fees may be paid separately $420 for I-130 packet

And a separate $1070 with the I-485 packet. Not sure because I'm not up on that part. Ask in the other forum.

We basically used those figures but added $135 for form I-131 for a total of $1625. Is the I-131 fee also waived along with the I-765 form?

Yes. States it on the form instructions: http://www.uscis.gov/files/form/i-131instr.pdf page 8, bottom of second column.

Both the EAD (1-765) and AP (I-131) fees are waived when filed concurrently with I-485 (or while I-485 is pending if you send a copy of your AOS NOA1).

p.s. One check is fine. Also I am reporting your post to be moved to the correct forum.

So this would mean the reason I've been rejected is due to overpaying? If that is the case is it also normal for their to be four I-797c forms?
