Hi

We have decided to try for a B-2 tourist visa while we wait for California to process our I-129. She is Thai and will be interviewing at the Bangkok Embassy. I realize it is a L.O.N.G shot but I figure it is worth a try. My understanding is the biggest hurdle is establishing ties to Thailand and substantial reason to return.

She has no assets or substantial bank balances. I will be paying her airfare, room & board. She has a daughter, but I'm not sure how to bring that into the discussion, or if it will help establish a need to return.

Anybody have actual experience or ideas for supporting documents which may help our case. Thanks

Having a daughter especially if she is a minor, will help. If she has a job, that helps too, as does you already having filed for the K1, as it shows you want to do things the legal way. Good luck!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I'd dig around on Thaivisa for help on this one. I still don't understand their criteria on granting B-1 visas. As I've said before, people that I never thought would get a B-1 in Thailand have been issued one. Then I've seen other people that I thought were a slam dunk get denied. I know having that I-129F pending is not a good thing. The burden of proof is on the applicant in Thailand to prove that she will return. I would think that her daughter would be considered strong ties to Thailand, and a good reason for her to return. All you'll lose is the application fee if she is denied.

These visas are almost impossible to get. When you throw in the fact that she has a pending petition for another visa its pretty difficult to prove she MUST return. Her daughter and a job aren't enough in most cases dealing with BKK.

The only way to know is to have her apply.

My Costa Rican friend had a really tough time getting to the states due to the fact that he had applied for a tourist visa and marriage visa around the same time. They saw it as a red flag, someone who was desparate to get to the U.S. and we were seriously wondering if he'd ever make it over here. Thankfully, the marriage visa pulled through. But I would not recommend going for two visas, personally.
