Good Morning VJ,

My wife has filed for her parents to come live with us in the United States. Both petitions are currently at NVC. Unfortunately my wife's granmother has started having some health issues and her parents most likely would not want to move here if the health issues persist or gets worse. I am assuming we should continue with their petition and hopefully her health gets better. If she does not get better what can we do?

If they get the visa to come here how long is it good for?

If her grandmothers health doesn't get better are the parents able to come and visit with their visa and then immigrate later?

If they were to come visit and want to immigrate later, how long after they arrive could they receive their permanent resident card?

Any other advise or options would be greatly appreciated. Hopefully we won't have to worry about any of this, but I want tounderstand our opttions if we do.

So sorry about the grandmother's health issues. A lot will depend on how long you think it will take until the grandmother is either better or you know for sure she won't/ she will pass away?

At this stage, the best thing to do may be to delay the visa interview by taking your time sending back the next set of documents, scheduling the medical etc. This can buy you a few months. Once issued, the visa is valid for 6 months (occasionally less, especially if the medical was a long time before the interview).

Another option, if you are looking at several years, is to withdraw the petition, and re-petition them when the grandmother is definitely better/ has passed.

Now, they CAN come to the USA to activate their greencard (they will get a stamp in their passport to act as temp greencard until the physical card arrives), turn around and leave again a few days/ weeks later. The problem is that the greencard more accurately is called legal PERMANENT residency, and they are expected to live in the USA. have bills, a home, and spend the majority of their time in the USA. If they do not, they risk their greencards being taken off them when they try to re-enter the USA.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
